My question involves criminal law for the state of: PA and MD
My husband was sentenced in Maryland ( where court is and assault-second degree occurred)for 2 years of Probation before Judgment. We live in PA and have for a few years now. It's 6 months into his 2 years of probation and last week a PA probation officer came to our house and said his case was being transferred to PA. He looked around our house and told us the new rules to his probation. These new rules were not part of his probation conditions. The new stipulations are that he has to be home by 9pm every night and he is not allowed to stay anywhere over night, other than his house for 90 days! The main issue is, we have a 2 week vacation in Disney that is in less than 90 days.... The PO said that it doesn't matter and that he cant go.
How can they just change things like this, add new stipulations, 6 months into his probation... and things that were never even brought up during court? I'm so upset, this vacation is paid for and the children will be heartbroken. I'm having a hard time finding any information about following the new state PO laws if the case is transferred. He called his attorney that handles this 6 months ago but he said he cant give him any information with paying a retainer fee...
My husband doesn't want this to be transferred to PA. The MD office is close to his employer and the PA is an hour away. Idk if it maters that he doesn't want it to be transferred. We are right on the PA/MD line.
