Custody and Visitation Issues: What Do Custody Evaluators Do in the Evaluation and Preparation of Their Reports

My question involves a child custody case from the State of: TX

Since this site has been helpful so far with real people answering, I thought I'd ask here about people's interactions with social studies / custody evaluations. Once our court order is signed, we will pay our evaluator and she will begin her job.

There's plenty of info on the internet about how to prepare and what to expect. And I even participated in one as a reference for our old neighbor back when TX called them social studies. I should know how they work. Their attorney even emailed me a 104 page report about them that was the complete study of my neighbor's so I can print it for them. My attorney doesn't even know who that lady was, said only 2 people around here do them, and it doesn't work like that.

When given the name of the lady conducting the evaluation, I only found 2 things about them, both were complaints, mainly because they didn't get what they wanted I'm sure; however, both complaints were consistent in saying that she is biased and does not do any research, ignores mental health issues, and writes unfavorable lies.

I am not perfect, but as a person, I am a good honest person who genuinely loves his kids, and the only thing I want in life are my kids - to make have a fair deal with my ex like we previously had before her mother stepped in and hired an attorney because she didn't like our arrangements. I have a great relationship with my kids, I KNOW my daughter would prefer more time with me, my son is too young to speak but we have a great bond too. But there are tons of things against my ex. It would take me 2 solid days of typing to explain. The biggest things being that she is alienating the kids from me by replacing my daughter's tablet and instructed her that she must keep daddy blocked; and she is using lies to gain leverage. Those lies being the reason why we (my attorney & I) decided a custody evaluation was best.

However, though I know the truth will prevail, it seems the good guy always gets the shaft. So I can't help to worry what is going to happen. My house if on the small side, but my daughter actually picked it out for me (long story) and loves it there, in fact, due to being in the country, it seems everyone loves it. It doesn't look that great on the outside, but it's clean and organized on the inside, big clean yard. I have cabinet locks and the whole 9 yards for the toddler (though don't really need all those precautions as he is much more behaved at my house than with mama) - But I don't have much, like my dining room table is a card table. I gave everything up when me and my ex separated 3 years ago then I moved in to her apartment, so I had to completely start over. It's a 2 bedroom, and if asked about sleeping arrangements when the kids are older, I won't have an answer; however my ex has a 2 bedroom apartment living the same way, where son has a crib in our bedroom. What should matter is that it is kid friendly, the bond that I have with both showing that I am a good dad.

Everyone is different, with different circumstances, and every evaluator is also different. My question isn't exactly "what should I expect" But more like has anyone had a bad experience? What things did they actually care about despite what their real job is to do? What references do they check (if any) or ask for any references on your behalf? Did they ignore anything that really needed attention? What should I really watch out for?

We just started our temp orders. My lawyer told me the order of things is temp orders, custody evaluation, final hearing. Last time we talked and I was discussing some matters about my ex (covered in other posts I've written here) he said something quickly about discussing it in mediation before the final. He talked so fast, and our topic was about corrections to the SAPCR that I didn't get to ask:

Will there definitely be mediation? If so, why couldn't we do that before our temp orders hearing? And my biggest thing, if we can do mediation, can we make it to where my ex's mother is not there? My ex-mil is the one running the show, and I'm sure she's doing things that even my ex doesn't agree with. I have to battle them both and their unethical attorney. I want to make sure it's just the 2 of us, the actual parents of the children. Is this possible?

My question involves a traffic ticket from the state of: Texas

I was backing out of my parking space at the hair salon parking lot, I doubled checked my surroundings to make sure it was safe to back out, which it was. I proceeded to back out slowly while keeping an eye for coming vehicles when all of the sudden I feel my car get stopped. As I was already ¾ out of the parking spot a car tried to pass me over so quick and we collided. It was a minor collision as I was safely backing out, only a scratch was made on my bumper. I tried calling the non emergency number but they refused to dispatch an officer. After my attempt, the passenger from the other party attempted and was able to get an officer dispatched. While we where waiting, the other party’s passenger approached me and tried to accuse me of being on my cell phone, as to why the collision happened. I let him know I was not indeed on my phone and I don’t appreciate him making false accusations only because I am young. Upon the officer arriving, he asked me as to why we needed him dispatched and I informed him we where having a disagreement on how the incident occurred. He proceeded to state “I can already tell you it was your fault. Cars that are backing out never have the right of way and need to be aware of their surroundings. You did not have the right of way.” He did not even ask how everything happened. Asked for my ID and insurance. He ended up citing the other party for no insurance or ID. AND cited me for “Illegal backing.” Did not even mention how it is also the reasonability of the other party to watch out for backing out vehicles. How do I go about challenging this citation since he just issued it due to statistics, and not on how the accident occurred.

Home Insurance: Bank Charging for Lapse of Insurance in the Past

Hi
I bought a home two years ago. My policy expired after one year and I did not notice that. 7 month later the bank informed me that there is no insurance on the house and I need to provide insurance proof or they will buy an insurance on my behalf. Immediately after I received the mail, I bought the insurance and provide it to the bank. Two weeks later, I received a new mail that since I did not have insurance for 7 months they buy and insurance for that past 7 months and will charge me for it.
Question
1- how can a bank buy insurance in the past?
2- since in that period of time (7 month in past) I did not receive any letter from bank regarding the insurance can they actually do that?
3- I know in the contract it is required owner to have the insurance. However for the period in the past that there was no insurance can bank actually charge an insurance price? note that this is not a penalty, this is an insurance amount that they charge me for.

My question involves labor and employment law for the state of: MN
I know of the Department of Human Rights - a MN State Agency, as well of EEOC - a federal agency that handle discrimination issues (like age, race, sex, color etc).
a. Can I file with multiple agencies or must choose one?
b. I am no longer employed with the employer, do I continue to answer employers questions? or I politely ask them that since now I have filed an external complaint, I should not be discussing on this particular issue with them anymore.
c. During a recent interview I had for another position with the same employer, the hiring manager asked me twice about my goals as to how I see myself in next 1-3 years.
I told them that I want to do this job well and just have a good time doing it. The hiring manager then told me that he talked with HR and he was told that I am interested in the next grade up (a one step higher than the job I was interviewing), and this role has no promotional opportunities. I felt embarrassed and while did a face-saving response, though it bugged me why HR would tell a hiring manager this thing - while it being true (my original discrimination complaint with them was a denial of promotion) though it is not something I want to share with a hiring manager and right during an interview. I did view it as un-ethical on part of HR, but is it unlawful?

I'm looking for some advice on my situation, I am the non-custodial parent and the father (who is the custodial parent) is threatening to drop them off to me at any time. He currently Lives in North Carolina and has mentioned just sending them on a bus or have them driven up. They are 3 girls ranging from 17-12 and is supposedly having issues raising them and does not want primary custody anymore. We do not have a civil relationship at all for many reasons, we just cannot seem to communicate. I get the children for 7 weeks in the summer and one week during Christmas. He supposedly is going to send the kids up after school and not take them back when the summer is over. I am a full-time student and only work part time. I am not able to care for these kids if he randomly drops them or refuses to take them back. Not sure what I can do or what my options are. Any help is appreciated.

My son was rear ended 12-27-17 in my 2011 Dodge Charger R/T. My car was deemed a total loss by the insureds insurance company, Liberty Mutual. At the time of total loss, the amount owed on my vehicle was
$16,403.99. The insureds insurance company valued my car at $13,407.00 which was paid to Ally, who financed my 2011 Dodge Charger R/T. That left a difference of $2,996.99. At the time of purchase, I purchased a GAP plan/insurance thru the dealership. The GAP insurance was thru Jim Moran & Associates, Inc, PO BOX 8566, Deerfield, Beach, FL 33443. I was informed by Jim Moran & Associated that they will only pay $1,316.99 of the $2,996.99. This is absolutely ludicrous. Their reason for paying only $1,316.99 is because the insureds insurance company, Liberty Mutual claimed that in the Market Valuation Report in the Vehicle Condition section, the report stated there were some "major wear" on the interior of the vehicle such as the seats, carpet, dashboard, etc. This is bull. There was no visible damage to the interior. The body shop where my car was kept for days; I was told they took photos of the interior, but unfortunately, I cannot have access to them because the car technically belongs to Liberty Mutual now. My question is, can this be fought in small claims court?

I'm looking for some advice on a situation, my girlfriend is the non-custodial parent with respect to her kids and the father is threatening to drop them off to her. Little background, she had primary custody of the children for a short time and through a lot of time and money, the father ended up becoming the primary custodial parent. It is through he did this as a control tactic and as a punishment to her. They do not have a good relationship, he is verbally abusive, controls when the kids speak to her and so on. Explaining how he is and what he has done would take a better portion of the average persons attention span, so I will leave that to what it is. If there are any questions though, please ask. He has been the custodial parent for approximately 6-7 years and recently moved to North Carolina from New York. He is having issues with the kids, which are 17, 14, and 12 and is threatening to drop them off in the summer. The current visitation schedule is 7 weeks in the summer and a week during the holidays. It seems once the kids visit her for the summer, he will not take them back. Now she honestly has no way to support them, she is a full time student pursuing a degree in nursing and works part time. She does not have the money or even the space for 3 kids. Not sure what the options are if he actually drops them off or refuses to take them back. Any suggestions?

My sister wants to move to Arizona with my niece and her boyfriend and leave my nephew with our parents. She has decided that she does not want to take care of him anymore. She does not have full custody of him and his biological father has been absent for most of his life. He also is an abusive stalker, I know that he was charged with assault on his ex girlfriends new boyfriend and I believe had a restraining order put on him.
My parents have been the most stable adult figures he has ever known, he is only five.

My question involves defamation in the state of: A disgruntled Xneighbor thought he would get even with me and posted a lie on my Google maps page.

I won a 25K judgement against him.

As I was filing/recording the judgement lien on the property that I know he has lived in for more than 4 years, and I was under the impression that his deseased father left it to him, I noticed the property (home) in in the name of his deseased father with "Revokable living trust ET AI" after it.

Also, the mailing address is not the subject property.

Does anyone know, for sure, if the lien I filed, will one day get me my payment? Is there something I am missing? Is there anything more I can/should do?

We wer happy back then. We got married and made plans for our future family. Then he decided to return to his birthplace. He got accepted in the military. Went to Chicago for the schooling. I arrived here in the US and stayed at my Aunts house. He said he couldnt get me in coz he is busy in the school. I said its fine. I understand. I look for job and try to survived he didnt gave me money coz I know he is still school.

When he said he is gonna be station in California. I moved again to my cousins family there bec. if in case he's gonna be station there its gonna be easier for me to move in with him. After 8 months he was sent to Virginia to have his C school I begged him to take me with him. I miss him so much. Ived been trying to understand him for so long..for not giving me enough time. And for just seeing me once. He said I can go there last Oct. but then he said Dec. and after a lot of fights..of me insisting to go there.

I finally move here in Virginia. But I was devastated when he told me that Ill be living alone. And that I will pay the rent in the apartment. To pay the bills and my food. What had happen to him? Federal Taxes: Wife Doesn't Want to Cooperate

Hi, thanks in advance for any advice or suggestions. I am in the process of a divorce here in California. Papers were filed and served early December, agreements and all other paperwork were signed and notarized near the end of December. Divorce papers are awaiting a judges signature, won't be final until early May. Wife worked two jobs last year and should be getting two W2 statements. I phoned here to see if she has received them yet and she has one and is waiting for the second one. She then tells me that she won't be providing them to me as she will be filing separately. Married - Separate? Can she do that? What are the ramifications? Can I just go ahead and file the same? Didn't think that it was an option. It might actually be good for me as she always claims dependants on her W4 even though we have none. I always ended up paying the IRS because she never had enough withholding.

If you read my last thread regarding telephone access, and other rights and duties to do with medical and education, then you know I am dealing with uncooperative ex. Except at first, we split the kids as close to 50/50 as you can get, if the kids are with mom, then our oldest did video chat with her before bed, and the other way around. We took turns signing her school folder at the end of the week. But that great co-parenting relationship came to a halt when my ex's mother hired an attorney because she didn't like our arrangement.

So here's what I believe are signs of parental alienation. And if so, what can I do about it, since there are no laws that prevent it:
* Replacing daughter's tablet, instructing her that she must keep daddy blocked on her chat and her Roblox game.
* Denying phone access. Since tablet was replaced, we've only talked on the phone 3 times, making child feel uncomfortable as she has to sit there on speaker phone next to mama while on the phone with me, and one instance she was rude to my daughter saying something like "because you HAD to talk to daddy"
* Making daughter a new Roblox game profile (makes daughter feel split)
* No longer allowed to bring tablet, and more recently not allowed to bring other small things.
* Being rude to me when I asked for any missed schoolwork .... being rude to me in general upon kid exchange
* The sudden change in visitation schedule from our own 50/50 arrangement to a strict court ordered one.
* Keeping me from knowing any aspects of their lives such as school activities & some dr appointments.
* An instance came up where I had to work overtime, I had the chance to take daughter to work with me (she loves it there) but ex refuses to let me saying "bring both kids 7 AM" during my possession schedule. It turns out there were plans to take them to a fun place while I work. However, my daughter still chose to go to work with me before I even knew they were tempting her with a fun play place.
* Using her time to buy kids unnecessary things constantly or taking her to fun places with the intent of making kids not want to be with me since I prefer routine. (I do fun things with them too, but no more than when we were all living together. I also buy things too, but rarely so not to spoil. Ex never did, and she makes the comments of "Daddy doesn't do these things does he") I mention all of this because I don't believe in spoiling the children that badly, we never did before, and now they expect so much when they go back to the mother and I am sure it's with intent to make them dread the time they go with me. Funny part, is all the money in the world doesn't seem to be buying their love; nothing can break this bond no matter how hard my ex tries.
* Using daughter's therapist to relay information such as new visitation schedule. (I was told by my ex's friend that she just couldn't face our daughter thinking that she will end up hating her, so she wanted the therapist to tell her)

If no good answers, at least I am glad this forum is here so I can vent.

Disability Benefits: How Will Receipt of Child Support Affect SSI

I can't seem to find any clear answer on the internet except that child support is considered unearned / in-kind income and does need to be reported to the SSA. But everything I've researches so far conflicts, such as an equation of 1/3 of it not counted as income; $20 of in-kind does not get counted; and that the child support is income for the child but does not clarify any further, not explaining what affects welfare, if any.

The beneficiary receives SSI - Supplemental Security Income because she has never worked a job in her life and started receiving it as a minor at the age of 16. I do know that they re-certify every few years, and ask all kinds of income type questions, one being if she receives child support.

Due to a recent separation, child support was ordered and will begin soon. My question is, if SSI is income based and they do ask, then how exactly will it affect her benefits?

J Visas: Aupair Wanting to Become a Student but Afraid of Becoming Out of Status and Declined

Hello,

I am from Ukraine, and I have been here with Aupair (childcare program staying with an American family) with J1 visa for almost two years. My visa states that I am not subject to the two year residency rule - that I do not have to go back after my program.

Before, Aupairs have been able to adjust status here, and even if they become out of status, they were able to change status. I was told by a school's officer that with the new administration, if somebody becomes out of status during the adjustment of status, they decline their application. And it takes at least 6 months to do the adjustment of status, and can be up to 12 months. My visa expires in May, and even if I apply for adjustment of status now, I will become out of status if I apply to student visa.

Another option I was told by some lawyer is to apply to tourist visa, which gives me extra time a couple of months, and then after that to change to student visa. There is no guarantee for my tourist or student visa accepted in that as well, and maybe it may even affect my application badly that I am switching too many visa types just to stay here.

And my other option is to go back to Ukraine and apply for a student visa there. But I am also worried that if my application is denied there, I will not be able to come back here and study.

And lastly, there may be new laws that will be in place that will make it even harder to get visa for Ukranians or other nationals. I am also worried about that.

What are my chances of doing adjustment of status here? What is the best route to take? To stay here? Or to go back? If I go back, what are my chances?

My Employer made an error in inputting my State withholding for 2017 and now I am left with taxes due to State. I sent the withholding form to the HR person in 11/2016 stating a state withholding of 5 and my Employer accidentally inputted 10. I approached them and they said that the responsibility for the taxes due falls on me no matter if my Employer made an internal error which they admitted to. How do I handle this? I am clueless on how to handle this? Am I responsible for paying everything even though its not my mistake? I had not clue that they weren't holding enough in State taxes. Appreciate the help.

My question involves malpractice in the state of: Illinois

Hello-
I will try to be brief. In the past year I was diagnosed with MS (after four years of hoping it was just transverse myelitis) and conditions related to MS including migraines and Trigeminal Neuralgia. The diagnosis of MS came from MRI results (lesions on cervical spine and brain), spinal tap (showed 8 bands) and three separate MS flares all managed well with three days of IV steroids. I also had a 35 day migraine in October and was hospitalized for 6 days. In addition was diagnosed with Trigeminal Neuralgia in Dec ‘17 and hospitalized for 8 days for pain control and then because the tegretol given (which was helping) was lowering my sodium. A f/u blood test a week later showed my sodium had dropped to 120 and I was told (convinced) I needed to return to the hospital and was there for three days.

I also have bipolar, anxiety and PTSD. These diagnoses were made when I was 24 in 1998. I am on Social Security disability for bipolar and PTSD. The bipolar manias have been well contained by medication but I continued to have a degree of anxiety, depression, insomnia and nightmares. However the IV steroids given for the MS flares have caused brief manias which I recognized and contacted my psychiatrist and managed by a short term alteration of medication. I have had the same psychiatrist for 8 years a woman who specializes in bipolar mothers who I sought out when wanting to get pregnant with my daughter who just turned 7.

In November, my psychiatrist was out of the country when I had a mania from the IV steroids so I had to work with her physician on call. This was the first time this happened. Since then she has been very different toward me. Before this our sessions would be about an hour because she would want to know what was going on in my life before discussing the medications. After she become very curt and then told me she would have to be out of the country often and I would need to find a new psychiatrist who could be available for emergencies. I said I understood but was sad because we had worked together for so long. She was indifferent and it was odd. After I was put on new medications for the Trigeminal Neuralgia she said I needed to find someone very fast because she couldn’t handle the amount of medications I was on. I take around 14 different medications regularly to treat bipolar, MS, Trigeminal Neuralgia and bladder/bowel issues from MS. I found someone and she said our last appt would be Jan 24th.

At that appointment, she spent a lot of time explaining to me why the medications were difficult to manage. At the very end of the session I thanked her for the past eight years and told her how much I appreciated it. She told me she would write a brief note to the next psychiatrist (she said she wouldn’t include her psychiatric notes.) She said brief more than once which was strange after 8 years and the fact that she handled communications about my disability to the Social Security Office. I would think there would be more.

Then she said, I’m also going to say that you have somatization disorder. She had never mentioned this before and I wasn’t sure what it meant so I asked her isn’t that like being a hypochondriac? She said something like that. She then told me I could decide whether to show it to the new psychiatrist or not. Then we were basically done.

So when I was home I looked it up and I started to get very upset that this was going to be included in a letter to my new psychiatrist, something she had never mentioned and she had never discussed it with any of my doctors or therapist. I asked my therapist her thoughts at our next appointment. This therapist was referered to me by the same psychiatrist. She was also really troubled, said it made her sick and worried how it would effect my medical treatment. Now I am also very concerned as I also have bipolar (which is still stigmatized) that I will be labeled basically a hypochondriac and my medical issues not taken seriously.

What is funny about this is I hate to go the hospital and really have to be convinced it’s necessary. I also respond well to a lot of treatments and drugs unlike people with this disorder. I am never looking for anything new (I have more than enough thank you) and besides the year prior to the MS diagnosis when I knew something was wrong have never felt that my health issues weren’t validated by tests or felt the need to have additional tests. It even says in the literature around this disorder that MS patients shouldn’t be diagnosed with this unless it is extreme as MS (and some other disorders) fit into this diagnosis but they aren’t psychiatric. This is why there is uproar over the new DSM V classification and they are hoping to make changes in the next succession.

I’m writing this because I’m wondering if I have any legal cause towards her for a misdiagnosis and how she handled telling me about the new diagnosis. I’m extremely worried because I need both sides covered: medical and psychiatric and her new diagnosis could cause doctors to consider any symptoms to be psychological rather than medical and at the least disrupt my care at the worst do me irrevocable harm.

At first glance, reading some threads here, I thought this might be a great forum in which to write what all is going on and get real people answering.

We are joint conservators and awaiting a custody evaluation (social study) for better orders. (The day of court for temp orders was crazy, basically threatened to lie to judge if I didn't agree to their terms, so me and my attorney felt it was best to let the evaluator do her job rather than the judge in a quick hearing -- really long story there)

The wording is normal legal jargon but does say that we have the right to receive information regarding education, medical, stuff like that; and also says under duties that we must inform the other conservator of such things. The best advice I got so far was to go back to court for clarification of the orders. My attorney agrees that these are non unreasonable requests, that they're my children too and I should have the right to the things my ex denies.

The history of us: in the beginning of our separation, we actually became great friends, and told each other everything about the kids, and it all stopped when her mother hired an attorney because she did not like our arrangement. My ex's openness with me came to a halt. She replaced my daughter's tablet so she is not unable to text or call me like she used to, and denies "telephone access." No matter how many times I ask, I don't get to see her folder from school anymore, so I am missing out on her education and school activities. And if I know about a dr appt, I have to prompt for info the next day (giving her benefit of the doubt she didn't feel like texting right after the appointment) And she chooses what things need medical treatment; eg: told her daugher's ears hurt, she didn't respond, found out a month later that she took daughter to ENT Dr because she complained of ear pain, and when I pointed out that I've been telling her about it, ex replies that our daughter hasn't complained yet.

Currently there's many things I feel like I missed. I don't know how much of it is petty, but you have to understand that they're my kids and it is so hard to not know what's going on in their lives. Like Friday both kids had a check-up, my daughter was complaining that she couldn't see well far away, so obviously I wanted to know how that check-up went. I texted Saturday in which my ex replies that her eyes are fine but will be making an appointment with an optometrist anyway. Yesterday about 7PM I texted asking if she had made that appointment and for when it is. No response as of yet.

Our SAPCR orders are in draft stage, and last I spoke with my attorney, I told him about all these things, how she doesn't update me about dr appts, and I don't get to see schoolwork, along with the fact that in our agreement she was supposed to allow telephone access a few times / week but is still denying it. He said those are not unreasonable requests, and will talk to her attorney about rewriting it so that it is clearer for her, but that we don't normally do that until final orders. I tried to tell him nevermind, only discuss telephone access, and for the rest to use as ammo against her, but he cut me off and said he's playing catch up and has to call his next client, cuz I kept saying "uhh" and changing my mind.

I'm not sure what to expect out of the next revision of the temp orders. I did email him to tell him what my main concern is, since for the rest, it is actually in the orders, just not clear enough for her to "do what a parent is supposed to do" (my attorney's words)

So my question to you guys, is if it's not clearly defined in the orders to inform me of doctor's appointments and what's transpired at them, and allow me the chance to see schoolwork and know of school activities, then is she still in the wrong? When my attorney said usually not until final orders as we use this for ammo during the temp orders, is he correct? Will it matter to the lady conducting the social study (custody evaluation)? Or do I need to take action now? I'm afraid to text her again to remind her I would like to know about my daughter's eye dr appointment.

Edit - Addon: Also last weekend my daughter told me that her mother said she'd be enrolling her in girl scouts. This really isn't covered under health or education, but isn't it something she should ask me about first, or at least tell me?

This is going to be a question about North Carolina Marijuana laws. One of my friends' (over 18) parents recently received a call from the sheriff's department. Apparently sometime coming up, there was to be a drug raid at a local high school where multiple people were going to be arrested. Anyways, in this call, the deputy stated and showed images of the friend smoking marijuana. There was a picture of a bong, joint, and actual marijuana. In one of the pictures, a marijuana grinder can be seen as well. The deputy stated that the friend would be arrested coming up on this basis. The charges apparently pending were two paraphernalia charges (one for the grinder and one for the bong), a possession charge, and an intent to distribute charged based on the amount that could be seen in one of the pictures (although it was actually not above the limit to be charged with this). My question is, would he be able to be charged just based on the pictures? What would be the best way to go about this and cause the least amount of legal trouble and possibly get out of this? If he were to deny that this was even marijuana and did not have anything in possession, is there still basis to charge him? When he is taken in this drug bust, would he be better off to cooperate and tell the truth, ask for a lawyer, or just deny the claims? He is very unsure of what is the right thing to do in order to receive the best outcome possible. Thanks for any help in advance!

My question involves a consumer law issue in the State of: California

So this is a new one for me. I bought something off of eBay and it arrived damage. No problem. Contacted seller and he sent a label for a return prior to refund. I stock the label on and dropped off at the local FedEx. FedEx tracking shows the drop off and the fact that a driver picked it up and took it to the regional distribution center.

Now this is where it gets interesting: the package has not moved from the distribution center. After the 3rd day I called FedEx and they put a trace on the package. Called back after five days and was told it is most likely lost but they wait seven days before closing the case. At that point the "shipper" can claim insurance if it was paid for. The package has now not moved in about eight days. I have contacted the seller twice via eBay but he is not responding/ignoring me.

Obviously the seller doesn't plan to step up (hasn't responded in over a week to multiple messages), he could be filling an insurance claim (if there is any) and pocketing both my money and the insurance (pure conjecture here), I don't think eBay will do anything because the item has not arrived at the seller, so I will be most likely taking this up with my CC which is lots of HA for me and even more for the seller.

So here is the question: who is legally the shipper and entitled to the insurance money if any and as a f/u is the seller still responsible for making me whole (i.e. refund me)? I physically shipped the item but the seller specified the carrier and paid for any services (including insurance if there is any). I know if I am selling something and it does not arrive I am responsible for refunding the buyer and taking it up with the carrier. I would think the same would apply here but not sure if there is anything legal that says it one way or another.

So, yesterday, the city shut off our water for non-payment, completely in error. No attempt was made to contact us prior, or to ascertain that the address and meter were correct. I called them, within 2 minutes of it happening, gave them the confirmation on the payment (I have literally never missed or had a late payment on the water bills), and they confirmed that their own system showed the payment had been made and our water had been shut off by mistake. I was told that they would contact the crew to come turn my water back on. Despite the fact that at that point whoever had turned the meter off couldn't have been more than a mile away, it took until today and another call for our water to actually be turned back on. As a result, we were unable to shower, wash clothes, or flush the toilet, were without drinking water, and were forced to waste our extremely limited funds purchasing food because we were unable to wash dishes. Does this rise to the level of negligence on the part of the city, and what recourse, if any, do we have to seek compensation?

Here's a little background story on my situation.

In 2014 I had a daughter. In 2015 my father took my son for what was supposed to be a Easter weekend, that following Monday my son didn't return. So I called and asked what time he was bringing him home. He said don't worry about it I got this. So I said cool. Soon after I started giving him cash money for the things that my son needed and the "trips" that my dad said they were going on. All that I asked for was pictures to see where my money was going to. My son would come by the house in the same clothes that he left in which were way to small. When i had money I would ask what size does my son wear and I wouldn't get a answer.

I used to have clothes and coats that became to small for him. So I had to throw them away. I stopped giving them cash and said that I'll get him what he needs just let me know and if I'm able to do it I will. They asked me to claim my son for welfare and income tax they even asked for custody and I told them no everytime they asked. I know that they just want to use my son for money and I refuse to let that happen. 1 my father and his wife are very disrespectful and very verbally abusive to me and I know if they'll do it to me they'll do it to my son as well.

I was letting him stay there at my father house because he had room compared to where I'm living. I was trying to wait for my section 8 to kick in but that doesn't look like its going to happen anytime soon and I've been on the list since 2014. I even tried to talk it over with them saying I'll pay X amount and it's gradually get higher. My father said no.

My question is can my father win this case for child support? Do I have anything to worry about and if so what do I need to prepare for in the coming days. The hearing is the 15th of February?

So this is a bit of a silly and minor deal and it's already been passed along to my insurance co., but just wondering what you guys think. I was in a parking lot that had angled parking and one-way traffic as indicated by a painted arrow. A vehicle drove past me, I saw it was clear, proceeded to back up slowly, then that same vehicle came flying at me in reverse. Rocked my car pretty good, pushed me sideways, hit my back right quarterpanel in the corner and ripped off my back bumper. I was moving when they impacted my car, but very slowly. I stopped half in the aisle and they ended up behind me and to my left (so, farther back up the aisle.) I was wondering if I would be at fault because they had right of way in the aisle, period, or if they will have some or all fault contributed to them because they were traveling against the flow of traffic at speed. Do arrows in parking lots even hold any weight? I know it's not an actual roadway, so if that's the case and arrows are "suggestions" then I'm probably screwed lol. Thanks!

I was laid-off subsequently and offered severance if I waive my Title 7 rights. My employment has been at-will. I consulted one Attorney who advised I must not sign it and live on unemployment instead. However EEOC told me that signing it does not affect my rights, the only caveat being that should there be a settlement, in that event I would need to account for that money.

As great as technology is, it sometimes doesn't work or my staff forgets to use it.

As a back-up I created a "one-time use paper timesheet" that my staff can fill out and return in order to receive payment. The problem I'm running into is my staff will sometimes hold onto this paper timesheet for weeks or months before turning it in. It really throws everything off when this happens.

My question is, can I legally set an expiration date on the "one-time use paper timesheet" when I issue it to a staff member? If the answer is yes, and the staff member turns the "one-time paper timesheet" in late, am I legally obligated to pay them? Also, if I can set an expiration date, are there rules on what time span is allowable? i.e. expires in 1 week from the date issued

I am represented by an attorney, I just am a little nervous still.

I was served with a warrant to search my home and garage for specific items.

I immediately surrendered the items, and they are listed in the police report as being found in the entryway.

In the meantime, the officers searched the upstairs of my home, in spite of having found all the items listed on the warrant. Up there they found a firearm registered to my wife, that predates our relationship. I am a convicted felon however.

They found no additional related items to their warrant. I was not in the home at all at the time, so office safety wasn't really an issue. The firearm was not in plain view from anywhere.

Do I have a good argument to suppress this evidence?

And now I'm in China for vocation. My CA driving license will get suspended for one month due to a previous 105MPH speeding ticket, one day after the date when I come back to US... Therefore, once I come back to US next week, I can't use my CA driving license. So I have two questions:

(1) Can I drive with my Chinese driving license while my CA driving license is suspended?

(2) How does police recognize a guy with suspended driving license on the road? Do they scan every car plate on the road and then find out if the driver registered with that car has valid driver license or not on their device? Or it just happens when they pull you over for another violation (like speeding) and only then find out your driving license is actually suspended?

A close friend of mine needs help filing for emergency custody. Her son has been beaten seriously by her ex-husband. The EX wound up in jail for two days with a TPO and her son is in the custody of his 85 year old grandmother (Father's mother). This is joke because the EX is known to push the grandmother around too. Her son has been seen with his father even with the TPO in place.

Background: The divorce process was handle VERY one sided by the local magistrate as the EX is a big donor to local politicians and law enforcement in a very small community. After spending tens of thousands of dollars trying to fight the good fight my friend signed over full custody to the EX. The EX has money and uses it to brain wash the son...who is troubled and certainly needs counseling.

With her past experience in the court system she is reluctant in spending more money on an attorney if she is only going to have the same result she experience in the divorce. Is there a way she could file for emergency custody on her own so she can get in front of a judge? This would allow her to see if that matter is going to be taken seriously before wasting money again. Children services and the sheriff's office are involved, but the EX holds commission as a volunteer deputy.

Drove up into a parking space underneath the pro Services area in the front of Home Depot there is a piece of rebar sticking out of a broken stop curb. Front driver side tire went right into it cause an instant flat. Went back few weeks later and curb stop is not fixed. Seems like a serious safety hazard as well since a lot of people walk back and forth through that space to enter the front of the building. Home Depot settled with me the price of the new tire. I have not cashed check yet I'm considering suing for loss of day wages I was visiting Home Depot while working on a job and could not return. AAA left me stranded 4 hours and the kid who came to fix my tire let the jack stand handle come down and up through my driver side mirror. This call cause my vehicle to be inoperable for a few days until I had everything fixed. I had to pay nearly $700 out of pocket and one month later still haven't received my settlement check yet from AAA. It's all caused me to behind in my month's rent, costing me late fees due to late payment off my lease. I have tons of photos document in the entire incident. I have an unusual situation although I'm probably not the first to have this particular issue. I've had a driver's license for 50 years and it's shown my "married" name for more than 40 years though I was never legally married. I've been licensed in both the state of Florida and Kentucky and my husband and I assumed we had a common law marriage. Upon his death in 2015 I found it was not so and it has caused several problems. I was living in KY and moved back to Florida and when I went to get a FL license was told I'd have to have a certified marriage certificate to get a FL license which of course I don't have. My KY license does not expire until July 2018 so I've continued to drive using it. My question is: is there any way I can continue to have a valid license in either state and what do I need to do? I even had a passport showing that married name but it was many years ago and I no longer have it. This has been a huge worry as I desperately need a license and I feel completely innocent and July is looming. Thanks for any advice.

My daughter’s father has filed a motion against me for reallocation of parental rights and responsibilities. I’ve never denied him his rights. In 2010 I canceled child support and gave him joint custody because he promised to be more involved. Even after joint custody and canceling child support he never even followed through with the custody agreement. I have proof of Facebook messages between us starting back from 2010. Messages showing that I have been trying for years to get him more involved with his daughter. He uses the excuse of me living in Cleveland being the reason he can’t see his daughter. But has no problem with traveling to Cleveland to attend a Cavs game or to gamble at the casino.He wants me to do the dropping off and pick up, making it convenient for him. He has never been a consistent father. Even when I lived in Akron he was not consistent. It has been years at a time that he has gone without seeing her. She is 11 years old now and since I moved 9 years ago, she has only seen him 4 times. Ages 2, 4, 8 and 10. Our daughter has a medical condition that has put her in the hospital several times. He has never been to the hospital to visit. He doesn't even call to check on her. He shows no concern for her at all. I feel that he's only doing this because hes in contempt for child support. He has to make consistent payments each week on time and he has not done so and is facing jail time come May. He doesn't even know my child. However two summers ago I put in the effort to drive down so that he could spend time with her. Once he was contacted by child support he went ghost again and stop contacting her. Whenever he gets mad about child support he takes it out on her. I have never denied him rights. But now I feel it has been so long, I dont agree to any type of custody. He doesnt even have a relationship with her. I dont even know where he even resides or his living arrangement. He knows nothing about her, not even the important things such as her health condition or the medication she even takes. I feel that If I wouldnt have gotten child support involved again then I would not even be attending a court hearing. He's doing this because of child support. He wants custody but at the same time couldn't even afford to pay the filing to file the motion. He does not work which was verified through child support, so he has no means of financially taking care of our child. He lives off of his other kids mom child support that he receives from her. I work fulltime and just graduated from College in December. Our daughter is well taken care of and gets very good grades in school. I believe as a parent, I have been very fair to him over the years. Is there a counter claim I can file against his motion?

In September I was in desperate need to find a last minute apartment near my school. On Craigslist I came in contact with a girl who had a bedroom available at an affordable rate, $375/month with most utilities included. I toured the apartment and it was nice enough and the location was great so I went ahead and signed the lease. Fast forward 5 months and I am going insane over not having windows. I'm constantly sleeping in because there is no vitamin D coming into my bedroom. My mood is consistently down and really, it's very much like having seasonal depression all of the time. The apartment itself is pretty small so it's not very easy for me to have privacy if I'm not in my bedroom.
I know that it is illegal to rent out a bedroom without windows for the most part but I have two concerns on my part:

This case happened in San Bernardino County. As the result of an illegal search, the defendant was charged with BP4060-M: Possession of a controlled substance (Vicodin). The defense attorney's motion to suppress was argued against by a law student supervised by DA, the cop had apparently never tried to justify an illegal search in court before, and the judge ended up granting the motion. The DA vowed to try again to get the evidence back in unless the defendant pled guilty to PC415-I: Fighting; Noise; Offensive Words. The defendant was eager to put this nearly 3 year ordeal in the rear view mirror and begrudgingly accepted the plea as long as the charge was no more than an infraction. The deal was time served (overnight in jail) and a $500 fine. Done.

.......except there is still a record online of the arrest, the case and the original charge of narcotic possession, which looks bad and can raise questions if discovered by a prospective employer or state licensing board. My questions are: How long will this stay on the website? Can the case get dismissed 6 years after the conviction? If dismissed, can the records, including the arrest record be sealed under 851.8?

One additional question: If records are sealed under 851.8 does the DMV have to seal and disregard their records, too? (separate case)

I was out of town for a month when an employee of mine asked when I was going to pay them for some renovation work. I told them they could wait till I got back in town, but they said they would prefer I mail them a check. I suggested that in the mail holder for one of the places they were renovating, was the business card. I suggested they use the business credit card. I simply said "blue credit card."

A month after getting back I notice a debit account I have with a different institution had charges I did not recognize. The last charge I recognized was at the ATM before I left, so I filed a police report and said that I believed it was lost or stolen there after I withdrew money.

Long story short, months later I get word that my employee was arrested and charged with stealing that card. I confronted them about this and they said I had authorized them. It became clear that they took a different card that was near the mail holder, but was not the business card I was referring to. I spend a lot on the business card every month, so I did not notice charges or no charges, because we have the business card issued to several members of the board.

In any event, I hired them a lawyer and apologized for the confusion. I explained to the police that this was a misunderstanding. I paid the bank back immediately and told them to reverse the claim because though I had not authorized the charges, I would have if I knew they took that card by mistake. The bank was fine and thanked me. The police, however, tried to imply I filed a false police report. The judge in the case released my employee on OR and I told the judge the misunderstanding and that I did not want them prosecuted now that I know what happened. I explained to the police that filing a false police report requires knowingly giving incorrect information to the police or intending to deceive them, based on what the ORC says. Nothing I said in the report was untrue. I did not authorize the use of that card - but had I have known, I would have and would not have reported it.

My fiance seems to have some concerns regarding the likelihood of him getting fulltime custody of his 6-year old. Married for six years. She came into the relationship with 2 children. He ultimately legally adopted them. They have one biological child together, who is 6. His daughter is repeating kindergarten, and at my urging he had her tested by the school, and they determined she has an auditory processing disorder and language disorder. Mom did not bother showing up to diagnosis and IEP development meeting with school.

I have been witness and victim to her wrath. She left and now lives with new man; however, the expectation seemed to be that my fiance should continue to be the floormat that he was for many years. She expected child support, health benefits, clothes, shoes, medical expenses, and random other money requests. Quite obviously, I posed a threat to that, but I quickly put a stop to that. Once she saw that things would change, she began encouraging the two older children to be disrespectful to me and to him. They have called him and told him how much they hated him and how they will punch him when they see him. I have been ignored, punched, and spit on. Blocking his visitation until she could vet me herself even though she has been living with her boyfriend for over 8 months and has not ever introduced him or told my fiance about him; she has actually told the kids NOT to tell him anything. The 6 year old has shared with me that her mom knows where my apartment is and she told her she was going to beat me up. Ultimately, the two older ones do not want to come over anymore because the dad and I have rules regarding respect for adults and each other in the house and also they feel like they need to hate us because their mom does. She's called on at least three occassions saying she had a job and would need him to keep them essentially 6 days a week(he is every other weekend now). He said that he was willing to keep them 5 days out of the week including the weekend visits that are his, but he would not be able to commit to every Friday. She got mad and just said forget it. However, every time she was supposed to be working we would see her around town. In fact, the mother asked for the maximum child support amount as long as she covers medical. Well, Medicaid dropped the daughter at the beginning of the year. Fiance just put her back on his plan especially in light of her disorder. When they were married, he entrusted her to take her to speech appointments in another state apparently while he was in school for the military. He said his ex told him they told her she was perfectly fine and didn't need the help. I urged him to call the speech center because his daughter does not show any signs of any speech help or not having a delay. The center stated that she only attended one appointment and refused further treatment. This was over three years ago.

I just wanted to provide some background information on that. Now let's come to the current issue: After the diagnosis, my fiance has been beating himself up and feeling like he has failed his biological daughter for not taking a more hands on approach and trusting his ex when they were married. He has been calling a lot of doctors and has secured her some appointments to see a speech pathologist. The mom's boyfriend has been doing the pick ups and drop offs lately. Her drama has decreased significantly. Then, the oldest child came over one weekend and left her e-mail up. Mom is in basic training!! The same mom that couldn't keep a job longer than two months since the divorce and didn't work at all during the marriage. The same mom that has told many people that her father molested her has left for military basic training and left her three children with a boyfriend of less than two years.

He asked the boyfriend if he could keep her for a couple of weeks while we tried to schedule appointments and other sessions. She has been over here with us(I moved in a few weeks ago), and she has not asked about her mom and keeps telling me that she wants to stay with her dad. She has also stated that her siblings tell her she is dumb and can't speak English. She barely knows her sight words even though her disorder limits her ability to remember things like you or I could. My fiance now has her on a wait list for therapy, and he wants to look at putting her in a speech school. She even came to me the other day and said, "I love my daddy." and I said "Why?" and she is like "because he helps me with sight words." Now the mom's boyfriend is asking how long is he planning to keep her, and my fiance is pissed because he just found out about the mom being in basic training about a week or so now, and he does not want his daughter staying alone with this man. However, he is not the custodial parent, he is noncustodial. He does not feel obliged at this point to report what he plans to do with his daughter to the boyfriend. He explained to the boyfriend about his daughter's disorder, and the boyfriend said "Well, you schedule the appointments. We will take her". My fiance is not leaving anything to his ex or her boyfriend; he wants a full hands on experience with helping her. She is currently seeing a school speech pathologist, but he thinks external therapy and putting her in a school where people can truly dedicate their time and resources to children like her would be the best...something the mom is NOT going to do. If it's not drama filled enough, she doesn't want any parts.

He plans to see a laywer this week. However, what are his chances getting full custody of this daughter? Does he have any legal recourse right now with the mom being in basic and his not wanting his daughter to go back and live with another man, who is not a guardian or custodial parent?

Someone hit my car in a parking lot last month and left a name and number, but never responded to my calls, texts, or any inquiries from my insurance agent. I’m not even sure it’s his number, although it is an active iPhone and I can see my messages are being delivered to someone. They continue to ignore my calls and texts.

I did have dashcam video of him hitting me and I managed to get his license plate number which I provided to my insurance company once they determined he wasn’t going to return their calls.

Yesterday I got a call from his insurance company! I just called my claims department and they said the plate number I provided gave them a VIN matching the car in the video so they were able to find him.

Does that count as a hit-and-run? Should I call the cops and fill out a report?

A young woman we know is planning to leave home as soon as she turns 17. In Michigan, she can do this and there are no legal avenues her father can take to force her to return home or place her under court supervision for the act of leaving. She has two good, healthy, stable options for a place to go, but neither one is in the school district in which her father lives and transportation to/from school would be a hardship if not an impossibility for either family. She also has one much less positive, less stable option that is in her current school district (living with her boyfriend).

My question involves estate proceedings in the state of: Florida

My dad and his wife (not my mom) have created a Limited Partnership. They say that it's a Family Limited Partnership, but I can't see documentation of that on the State Div. Of Corporations website.

According to their word, they split 99% of the partnership between me, my 2 brothers, and my dad's wife's daughter ( the 4 limited partners). So we each own 24.75%. Then, my dad and his wife (the general partners) own 1%.

According to the Florida Division of Corporations website, the 2 owners of the Limited Partnership are a revocable trust in my dad's name, and a revocable trust in my dad's wife's name.

I understand that the terms of these trusts are not public record. They are kept on file presumably at their attorney's office after being signed and notarized.

My questions are:

1. What if they get divorced? According to average life expectancy, they will both be alive for another 25-30 years.

2. What if one of the Limited Partners (children) dies before both of the General Partners (parents) do?

3. Can one General Partner change the terms of the Partnership after one of them dies?

I was speaking with States Paralegal running a contempt hearing. While in the hearing in side counsel discussing the contempt of child support, I discovered surveillance images in her file that was provided by an attorney not on record but was mothers counsel months ago in a most contentious family court matter. In an attempt to sway the aDA the photos were of me and some personal items which had to have been acquired through hired surveillance of me at my residence or the hacking of my smart device.

Representing myself Pro Ce I requested from the ADA the documents and she clearly misspoke suggesting she didn't know how she had received images of me and suggested that I had no right to them and would not get them. In CrR 4.7 The Prosecution Attorney should disclose to the defendants any electronic surveillance including wiretapping of the defendants promises or conversations to which the defendant was a party and any thereof.

The fact that my privacy was violated and used for the purpose of misrepresenting my ability to pay gobs of money, or lack of, truly compromises my ability to fully represent myself with out the influence of these images along with an already racially and gendered bias that exist deeply in family court Also I really am being harassed and to get to the bottom of this matter will help me to resolve this.

My question involves labor and employment law for the state of: California

If my classes are only on Mondays and Wednesdays and the remainder of the week I am available for work, does EDD in California typically deny cases like this simply because I am not available 9-5 on those two days of the week? My current job I only work Friday, Saturday, and Sunday.

My lay-off date has not arrived yet, do I apply immediately or wait for termination date?

I'll be given a severance package upon termination.
Now, weeks after being told I will be terminated, I was offered another position for the same employer. This new position has less pay. I initially agreed to take the position but am now having second thoughts, I have not signed any papers.

Am I legally obligated to stay with the employer now that I said yes? Or can I still rescind my decision and just accept being laid off and receive my severance?

Hey guys, I was wondering if you guys could help me fight this ticket I got and maybe get some information about what to do.

Last night I was driving at around 12 a.m. and I was pulled over for speeding.

On the state California Department of Highway Patrol notice of appeal I was given two different codes and sections one is speeding 22349 (a) VC speeding secondly I got another one 16028 a VC no proof of insurance. On the second violation I can fix due to the fact that I have insurance just not on me at the time. However on the speeding it does not show how he was able to figure out the speed I was going in. the fact that he did not use radar or lidar or even was pacing me I was in back of him at the time is what makes it hard for me to understand. He then slows down and pulls in back of me at this time I'm going 60 and less, then he pulls me over saying that I was speeding. Is there anything I can tell the prosecutor or the judge that will help me win? For example, like he was not able to get an accurate reading just on his opinion and his observation. Keep in mind I was in back of him the whole time until he pulled me over.

When I signed my lease back in May, it was with a girl I know, Person A, and two strangers, Person B and Person C. The lease goes from May 31, 2017-June 1, 2018. We were all required to have an individual co-signer in the event that us an an individual is unable to pay rent. The rent is charged to us as $350 per room. We are told we are not allowed to put locks on our doors and to "learn to trust each other." Upon move in day, Person C bailed. Enter Person D, who signed a new lease, which was the original lease with Person C's information whited out. Only Person D signed that copy. Come July, Person B moves out after stealing from me and leaving the apartment in general filth wherever he touched. Enter Person E and her boyfriend, who sign a lease we never even saw, nevermind signed. They moved out December 1st and now the landlord is trying to hold the remaining tenants responsible for their $350/month portion of the rent for November, December, January and so on until he fills their spot. We had mice and all he did was blame the upstairs apartment and Person E. Gave us tiny sticky traps and broke his no animal policy so we could have a cat to get rid of the mice. Asked us to remove the trash from the basement that was never ours to begin with and never picked it up. The trash has been sitting on the side of the house for months. He won't provide us with a replacement for our second recycling bin (have to get them from the city) that was stolen, leaving us to put recycles in the trash cans causing a backup of trash each week. Our bathroom ceiling was leaking for 2 weeks and he didn't believe us even after mushrooms started growing out of the ceiling. Told us it was from the boys upstairs getting in and out of the shower. It would look like it was raining in our bathroom any time they took a shower. Took his handyman telling him that it was a serious leak, even after seeing it for himself, to believe us. He has me going upstairs to speak with the second floor tenants or trying to spy on them for him. He lives over an hour away and rarely comes by the property. Anytime we suggest something needs to be fixed he is quick to dismiss it. There was water in the basement (large puddle on the floor) and he just told us is was moist down there. Only gave us a shovel after I complained after a huge snow storm even though it states in the lease the shovels would have been provided as well as salt. He knew about the storm for days. He has called me more than once at 10pm to complain about my roommate. One time at midnight after she called him late, he called right after hanging up with her to complain that she called him so late and couldn't believe how rude she was. He is extremely unprofessional. It left a very bad taste in my mouth after being reassured multiple times that I would not have to worry if these strangers I signed with did not pay their rent to now be told "well you know legally I can and will hold you guys responsible for their portion of the rent." I apologize if this is confusing. This is just beyond stressful and he seems to be taking advantage of the fact that we are young college kids who don't know anything about leases or our rights when it comes to this sort of stuff.

My question involves a child custody case from the State of: Alabama

I have been in a long battle for my daughter over custody. I am the father, and the mother used to keep my child from me until we finally went to emergency custody court. I filed. The mother had In-Laws picking my child up from school under the influence of alcohol, and i had a witness from her family testify. The judge said it was serious, but not serious enough for me to gain emergency custody. My attorney did not mention the fact that my daughter has been living with a fugitive for the past 5 years, and also forgot my case when it was time for trial, as the judge told her "you better show me something soon or i will dismiss this case" as she sat there blankly looking at me for minutes as she put ME on the stand. then the mother of my child turned around and brought me to child support court and gained more child support. My attorney did not fight for me there either, so i terminated my attorney. I could not afford to keep paying her to do nothing, but to make it all worse, is now i cannot afford to get another attorney. I am trying to do this myself, and was wondering if I could copy some of the opposing parties interrogatory questions, or if that was against the law. Any and all advice will be helpful. If I lose this case, I will try again when i get more money with a different attorney, but I cannot give up for my daughters life depends on it.

Denial & Appeals: Fired Over Confidentiality Issues After Recording a Conversation With a Supervisor

My question involves labor and employment law for the state of: California.

I worked for a non-profit mental health organization for two years. I loved my job. When the department employees had performance reviews, I received high praises along with a raise in the department. At first my boss and I were on good terms, but quickly noticed she wanted to create divide within our department (us VS them). I did not play into the role she wanted for me.

To the part on how I got fired. I have ADD, and I am embarrassed about it. But luckily for me when we had our meetings she would encourage us to take photos of flowcharts and at times I would record meetings because my note taking sucks! Then one day she accused me of making a mistake and it was clear to me that I did not make the mistake. As usual I took my phone and recorded the conversation in the event I was wrong and to go over how not to make it happen again. Our meeting didn't go well, she kept accusing and I told her that she was incorrect. Then we have a one on one meeting the following week to go over work. These meetings are supervised due to my boss not being able to get along with others. Anyway she began to attempt to throw me under the bus when I said she was mistaken and I could play how our conversation went as I had it recorded. My boss said I want to hear it, and her supervisor told me that it was against the law.

I told him that I had no idea and that I record school lectures all the time. So asked me to play it so I got up went to my desk because I forgot to bring it (ADD):wallbang: and when I returned to the conference room I played the recording at her request. She said that she would file a grievance ( i think she got embarrassed) and her supervisor said I should file a grievance too, but I chose not to because I saw how all other complaints were handled (they weren’t). Soon after I got pretty sick.

I was out for about a week or so. Then about two weeks later I was asked by HR and my supervisor handed me a letter with HR and the VP in the conference stating that I was being fired for violating penal code 632, engaging in criminal conduct and committing a breach of trust and likely to have compromised client information as it was often part of conversation that took place with my supervisor. I was heart broken. I have never been fired from a job let alone a job I loved. So now when I try to find a job I am considered no-rehire, so now I am marred. Can't find a job so I filed a claim for unemployment as was denied benefits (not surprised). I knew I would have to do an appeal but do I have a case? Thank you for reading my long winded explanation.

I didn’t think I would find myself here, but HERE I am. Oh well that’s my story. I would appreciate any advice or suggestions.
