My question involves a child custody case from the State of: California

I began receiving Social Security Disability in 2010, and from 2010 through 2016, had a garnishment applied to my monthly payments for my child support by the Department of Child Support Services in California.

Little did I know, my ex began receiving Supplemental Benefits for the children in 2011 based on my claim, payments which were far in excess of the garnishment amount (over 3x the amount I was ordered to pay).

Ultimately, I was able to get a new order in place which reflects the offset, and the garnishment is no longer being applied, the court having recognized that the supplemental benefits satisfy the support order. Ironically, the new support amount is nearly twice the amount previously being garnished, and is still more than satisfied by the supplemental benefits (that is how far in excess my ex was over-payed from 2010 to 2016).

I now want to recover the 5 years of over-payment from my ex (only the amount that I paid directly, not the amount in excess paid by Social Security).

The law in California is very clear regarding recovery of over payment for retroactively modified orders (FC 3653), does this principle apply to my situation?

I have found cases in other States where someone in my exact position was able to recover the over-payment, but not in CA, how much weight would these cases have in a CA case?

I know that there is no question that I am entitled to a credit, but I am seeking recovery.

Traffic Accidents: Can an Insurance Company Recant a Settlement Offer

My question involves an injury that occurred in the state of: Georgia


Hey y’all I need some opinions on a situation I am currently in, I’ll try to make a very long complicated situation short and to the point. I was in an accident last year and my vehicle spent over 90 days in the shop. The 3rd party insurance company had me pay up front for the rental and is now refusing to pay me the full reimbursement amount. The insurance company is claiming the body shop is at fault for the delays while the body shop is pointing fingers at the insurance company. And here I am out still out over $2,500.

Insurance company is claiming they are only legally liable for 16 days of rental (based on the supplement repair time) but are offering to pay me for 50 days of rental ($1,200). Body shop is unable to provide additional documentation of delays and looks like they are unwilling to help me cover the costs. I filed a claim with the insurance commissioner and they are siding with the insurance company. At the same time I filed a small claims court against the other driver, however he is no longer at the address on the police report and was unable to be served.

I am pretty much ready to be done with it and just ‘eat’ the $1,000+ dollars I will be out. I have thought about notifying the insurance company of the small claims case against their driver (I won’t tell them he hasn’t been served) in hoping they would be willing to settle out of court in attempt to get a few more hundred. However my concern with during this is they call my ‘bluff’ and take away their offer to pay for 50 days. Can they legally take back a settlement offer?

Also who did you think should be held responsible? Is it too late for me to add the body shop onto the case as a defendant? What do you suggest the next step I take?

We bought the house as a brand new construction with brand new carpet (brand new everything bc we were first owners). After a year of living there we had to move out of state and rented that house out. The lease stated no pets. The renters lived there for only 1 year and moved out last week. We also just put the house up for sale and several potential buyers that came by this week said the house looked great but could tell a dog had lived there and that was a deal breaker. After doing a walk through the carpets smell like dog and there are several stains (the carpet was only 2 yrs old). The base boards are chipped and scratched in a couple places. The back yard has dead grass from dog pee. I told the tenants the feedback response of what the potential buyers stated about the condition. We are having the carpets cleaned and a cleaning service to come by. The tenants stated that Santa gave the kids a dog for christmas and have only had it for 2 months. They also claimed that the dog never went in any of the carpeted rooms. I looked them upon their public FB and instagram feeds and there are several pictures of the dog on our carpet and it also appears they have had the dog prior to when they moved in. They falsified claims of not having a dog when they first moved in and also falsified claims of when the dog took residents in the home. I told them before they moved in that we may have to move back some day and that I am allergic to all pets with fur and we made no pets a strict rule. We have not given them their deposit (1 full months rent) back yet because we are trying to decide what amount is fair. Any advice?

Hello!

I divorced a few years ago in the state of Michigan and was granted full custody with no stated visitation for the other party. My only real requirements are to allow phone calls and letters, and visits if reasonable.

2 years ago, my wife (step parent of my children who is a military member) and I moved to NH. This was agreed upon by the other party and allowed by the court. Again, no required visitation, just phone calls and the agreement that if he manages to visit from out of state, I allow the visit if it is reasonable.

My wife is making rank, so there is a very high chance that we will be moving to a new state this summer. This move won't affect visitation in any way, since there is no ordered visitation.

Do I have to file with the court in MI again to allow this move? Or was that finished once they allowed the first out of state move to NH? Hypothetically, if we are moved to CA, do I have to file with the court in MI to allow the move, or do I just need to notify everyone of the change in address?

My question involves criminal law for the state of: MO

This is kind of a unique situation, I think. Back in 2014 we found out that our 14 yr. old daughter was having a sexual relationship with a 19 or 20 yr. old man through letters we found that she had written. We took her to the police department to file charges and she wouldn't cooperate, saying nothing. So nothing ever came of it. They just dropped the case because no one would verbally admit it. So a year goes by and we think this guy is out of her life. Well a few months after she turned 16 we find out that she is pregnant and with the help of her grandma was able to hide the pregnancy for over 5 months. From that day on there was nothing we could do because she claims that she doesn't know the guy who got her pregnant. He was just a guy she hooked up with and then moved out of state. So even to this day she acts like she doesn't know, to us, her parents.

At the age of 17, a few months before turning 18, she moves out to go live with the grandma spoken of earlier and this is when we find out for the first time in years that the now 23yr. old is still dating our daughter. We saw through Facebook posts that he is visiting her at grandmas and no one over there has a problem with it and we cant get her back to our house because shes 17 and the police wont do that here.

So the speculation grows that he may be the father to her baby. Well recently a month after she has now turned 18 we have seen on his facebook page that he has her daughter listed as his daughter. We think we've got him. If this is true then he would have been 21 when getting her pregnant at 15. So we call the police again to see what we need to do to press charges and they say.... "If they wont admit to the police that they have had sex or that the baby is his then they cant do anything. Him claiming that he is the father is not good enough, anyone can say they are the father to anyone so that doesn't matter. This is a situation of NO VICTIM NO CRIME. They cannot force anyone to take a DNA test, that would be something that we would need to get a lawyer and try to get done and then if it showed he was the father they might so something."

So we are lost as to what to do. Why wont they investigate and claim that we are they ones that need to do the investigation? Isn't him stating he is the father enough for them to get a dna warrant? Of course as they stated, somehow rape is now a victimless crime. Boggles my mind!!

Well we contacted a paternity lawyer and they said they didnt handle stuff like this so what are we to do? To make matters more difficult for us to do our own investigation we have never ever meet this guy in person. He has been someone just lurking in the shadows until now where the two have been offered sanctuary at grandmas. We don't know his real name. He uses 3 different names as far as we know because we think he might be an illegal citizen which complicates the matters further if we were to try and get him to court for a paternity test.

So has anyone ever dealt with anything like this that can give us any advice on getting the police to get this guy or any advice on how to proceed with doing it ourselves and somehow getting him to court? Any advice would be greatly appreciated!!

Retailers: I Think I Accidentally Shoplifted, I'm Freaking Out

My question involves a consumer law issue in the State of: CO

I got a chance last night to go shopping without my 3 month old and my daughter while my husband stayed home.

So I was kind of rushing and went to several stores and at Target I had to get a few lamps and I had a large vase.
On checkout I asked if they had some of the matching furniture for my crib I bought, and if I could order it through them ECT.

The first woman at the register was flustered and spent a few minutes trying to figure something out. Then she called another employee possibly manager and told her I needed help and I went over to her counter. A couple was impatient ly waiting behind me and I we were hurrying she was writing stuff down and she gave me a piece of paper and I left.

Today I couldn't find the receipt and just the paper she gave me wrapped around my card. I don't know if I paid and I'm panicking reading how other people had bad things happen going back and telling them.

I think since the items were large and not bagged it made it more confusing.

I've had a parking ticket in my life and that's it, my entire family is in law enforcement... Should I call them to see if they know?

Advise- on Business W/Out a Contract and Furniture with an Ex

My ex is treating to take me to court to return $1,000 to his business account and get all the furniture from his old apt and my current apt. The story behind the $1000 is we open a business together, 50/50, 50% gains/50% losses. When we filed for the LLC S-Corp he solely put his name (me not knowing anything about starting a business and thinking it was ok), we then opening a bank account which I was secondary on. I was able to write the checks and had full access to the account. To open the account we both put in $2,000 each, mind you I paid half to file for the LLC as well. He then ended up "firing" me when I was not able to put as much time into the business as he was (I work full time and he is unemployed). He rehired me back for 10% of sales (I still had full access to the business account), after the last event, we got in an agreement and he said he was not going to pay me for the last event. I then withdrew $1000 from the account since he threatened to not pay me. He did end up paying me the 10% in sales but he wants me to put back the $1000 and indicated to me the $2000 was an investment which was basically lost when he fired me. No contract was signed and he was able to sweet-talk a bank teller to get me off the business account now. (This is one situation)

The other is he is saying he is going to take all the furniture (says he has the receipt but in fact I do). He moved out in November and never asked or took anything with him since he has a fully furnished apartment. Now that I am no longer talking to him nor giving him half of my initial deposit for the business account, he says he wants everything back. He also indicates I will pay for the court costs? Is that even possible?

My question involves civil rights in the State of: Illinois. I am 20 years old with absolutely no criminal history whatsoever. A couple of months back I was stopped by an officer for having LED lights illuminating my rear license plate. I was not aware that in Illinois, that the light had to be white. The officer pulled me out of my car, was verbally abusive through the entire traffic stop. He issued me a citation for the lights, and then proceeded to have me remove the lights, which I obliged. I was not working at a fast enough pace for him, so he became more abusive, threatening me with a felony. After I got the lights out, he took them from me, and told me that if I were stopped for not having a license plate light, I could explain this stop to them. I followed up two days later, meeting with the chief of police, not to argue the ticket. I learned through the stop that the lights were illegal on a car. I wanted my property returned toe so that I could return them for a refund. Twenty dollars can get a college sophomore a few meals. I was also prepared to inquire about whether what the officer did was considered theft since it is not illegal to possess the lights, but didn't have to as the chief was very understanding. He gave me my lights back, and voided the ticket for me which I did not ask him, or expect him to do. The officer who wrote me the ticket in the first place apparently has a reputation for things like this.

The latest being stopped for only having one screw in my license plate. Within one minute, I was told I was being detained and there were three other officers on scene, including a k9 unit. The k9 scratched the crap out of the side of my car, then they proceeded to go through my car, going so far as to damage my dashboard while trying to pry my stereo out. After not finding anything, they lete be on my way with no citation. I was wondering if I am privileged to the dash cam video since there was no citation issued. I am considering taking it to an attorney or publishing it on Facebook just to show people what they are doing. Any feedback would be appreciated

How to Dispose of a Trailer with Loan Past the Statute of Limitations

I defaulted on a loan for a travel trailer when I lost my job 9 years ago. The loan is now past the statute of limitations but I still have the trailer. The trailer was also vandalized and is not usable. The loan has been written off and I am still storing it at $100 per month. My wife & I are barely making it month by month and are being garnished by the IRS for back taxes in excess of $10,000. I am at a loss as to what to do with the trailer, we cannot sell it as we don't have the registration and I can't go on storing it but I can't afford to pay off the debt either. I don't even know at this point who it is registered to as the DMV stopped sending registration renewals. Can you please help us?

Today I received a call from a debt collector trying to collect on a lien sale.

On September 21, 2015 I got into an accident and totaled my vehicle. The tow company gave me the option to give them the vehicle in lue of paying for towing fees. I signed the documents they gave me, they took it away, I did a release of liability on the internet, a few weeks later I received a "Notice of Pending Lien Sale for Vehicle Valued $4000 or Less" in the "To Whom It May Concern" I decided to choose option 3 and "Disregard this notice if you no longer own or want this vehicle so I can proceed with the sale. However, if you are the last owner of record, you may be liable for removal and disposition cost and lien not satisfied by sale of the vehicle"

Well apparently option 3 was a catch 22, about a year and a half later I get called by a debt collector because they were not satisfied with the sale of the vehicle.

My question involves collection proceedings in the State of: WA

I am 25 years old. While in college, instead of taking out student loans, I charged parts of my tuition on my credit card as well as general living expenses. During my time also in college, I was working non-stop for a business start-up (I was part-owner) which completely failed. I was only originally charging my college living expenses/tuition (and not all of it by any means, that accounts for maybe $10,000 of the debt) because all of my other income went into paying for the start-up investment costs since I owned part of the company. The company went bankrupt in November of 2014 and after that, having not much work, slowly added and compounded my debt obligations. It is now February 2017 and every single one of my 7 cards are maxed out.

All of the charges I did were for personal use and business investment use. I am self-employed and run my own IT business which payed most of my day-to-day expenses (besides when I was funneling money into the start-up via both my business income and credit card purchases). The reason I was granted so much credit was the length I had of good payments (I haven't ever missed a single payment up until last month (last payment was December 30th and all of my accounts were current), ever since I got my first card at age 18) and the fact that I was running a successful business. I used to pay the balance off in full every single month up until a few years ago when I could no longer do it. Plus my personal business was suffering some downtime and income wasn't as great. So yes, I turned to the credit card companies.

Yes, I know it was dumb, yes I know it was wrong for me to do - but I was trying my best to "have my cake and eat it to" so-to-speak. I'll never do something like this again.

I want to make it clear about a few things:
1) I always payed my taxes and did them correctly via professionals. I owe nothing to the IRS.
2) I have no student loans
3) I own no real property - this includes houses, cars, etc. My truck is from 1985 and is worth maybe $1000 maximum. I have only ever rented. I have never in my life missed a rent payment, nor will I be in the future.
4) I spoke with one bankruptcy attorney who told me this is exactly why bankruptcy laws are there and I could toss in the towel at any time with only destroying my credit for the next 10 years. He advised Chapter 7 since I have no assets. He advised I could probably file it myself with paying him for a little help/guidance.
5) All 7 of my credit cards are maxed out and unusable at this point.

To reiterate - I only owe credit card debt. I also never even took out a single cash advance. No house, no expensive lavish items, etc. My couch in my living room cost me $115. Consider me a poor college graduate with a massive amount of CC debt.

Now with all of that said. I have been diligently applying for a new career. In less than a month I have already lined up two interviews for high paying jobs in the $70,000 - $110,000 salary range. I no longer wish to be self-employed. I have a strong feeling I will get one or both of them as offers. One thing I am is a hard worker. I put myself through school without student loans, and worked my A$$ off nonstop. Only this last year did I feel like I really needed a break post-college and slacked off enough to build up a massive amount of debt. I won't go into detail, but I needed this both emotionally and physically for myself at the time.

WITH this new salary, I am really tempted to try and settle the debt with the credit card companies. In exchange, I settle for less, close the accounts, and cut a deal with them that doesn't allow them to mark my credit up with a "settled debt" notification. I've heard this is possible - if not, please let me know. I have no motivation to "settle my debt" if they are going to mark up my credit report with "settled debt" entries from 7 cards. That would be almost as bad as declaring bankruptcy.

I am a very good negotiator, and don't want to try for any of the debt settlement scams. I want to do this on my own. At this point I am only 30 days behind my last payment - I've heard that it takes at least 6 months for them to charge it off and send it to collections. That gives me some wiggle room at this point to negotiate with each card company directly.

I've been very open with them telling them I am unable to pay at the moment due to financial difficulty. I haven't told them anything more then that. It's got to be pretty obvious from their end that I stopped paying as soon as the cards were maxed out. They probably know that it's over at this point and not collectable.

Any advisement would be appreciated. And please, no lectures for what I did to myself. I already heard enough of that from my parents who, I'm surprised, have not disowned or disinherited me yet. Besides my mounting debt, I've been an hard worker, excellent student, payed my own rent, never asked my parents for a dime. And I won't do that either.

My question involves a child custody case from the State of: California

I have been having some major behavior and school problems with my 15 year old daughter. Recently her father and I have made the decision (jointly) for her to change school districts. As a little back ground her Father has always wanted for her to attend the school district at witch he resided in.
Witch is understandable given the fact that at the time the custody agreement was filed I resided in a not so great area. Since the custody agreement in 2008 I was able to move to the same area at witch he resided in 2011. In 2013 he moved to a more upscale neighborhood and tried to get custody of my daughter based on the fact that the area he lived in is now much better then where he lived for the past 7 years. Courts did not agree and my daughter still resided with me. Recently I have been having some issues with my daughter in school and home. Like I mentioned above we jointly agreed to her switching schools but he has now filed for legal and physical custody.
When courts did not grant him custody back in 2013 he's just had a "well you deal with her attitude" and has not been cooperative in disciplining her. She recently went to him saying that she feels threatened by my B/F (whom has been around for the past 8 years). And now he's filed for legal/physical custody after putting a restraining order against my B/F. What are the chances he is granted Legal/Physical custody? I have no criminal back ground, a job and home for my daughter. I am not an addict of any sort and I know I have provided for my daughter every way possible.

I plead out on condition discharge with probation. After I completed probation I went through the process and had the charge expunged. GBI and the arresting county police both say the charge has been sealed. I got the letter from GBI notifying me that the charge has been expunged and sealed. But the charge showed up on the employers background check and I was denied. They said the county clerk has no proof of expungement even though I provided them with the paper from the GBI. I called the county clerk and they said they never received anything saying I've completed the probation but see where the DA has went ahead and approved the expungement. Went over her head sort of speak. And that there's nothing she can do for me expect that I should reach out to the probations office. My questions are, how is it even showing up is its sealed? Today they placed and poured their fence between our property lines. They have placed their fence on the very line of the center of the easement between the properties. However, the contractor dug the holes and concreted so large, they have dug up the sod on our side and even dug up our sprinkler system. We are not even sure if its legal to build a fence within the easement. But now we are certainly not happy about our expensive professionally installed sprinkler system being dug up for the placement of their fence. Who is responsible? My question involves collection proceedings in the State of: CA

In 2006, I had a debt with bank account which was sent over to a collection agency (I don't have a date when). On Feb. 27, 2007 the collection agency had sent the collection account to an Attorneys office, and on July 11, 2011 a judgement for the debt was issued to the Attorney's office by default (didn't receive notice, may have been while moving locations).

From what I understand of the debt time frames and the Statue of Limitations in California; the 4 year for written contract had past. I attempted to contact the plaintiff in order to resolve or dismiss the judgement based on the Statue of Limitations and was told that they had "filed" in 2009 and was issued the Judgement in 2011... I have no clue as to what they had "filed" or why it took 2 years to get a default judgement.

I attempted to contact legal aid, but didn't get much assistance so I was referred to the County/State BAR organization.

I'm needing assistance as to how to validate, resolve and/or dismiss this judgement from my credit as a $300-$600 original debt jumped to $1,500 with the collection agency and is now surpassing $2,500 under a Attorney's office control and is steady climbing more or less as they repeatedly file new attorney charges and continuously file a bank levy against the same 1 account that has been closed for years.

I feel that I should need to point out that I do remember paying the debt, but as so much time has passed I would have no way to trace a charge back but there is a 50/50 chance that I may have not paid it. I don't mind working out payment arrangements of some sort to work the debt down, this would be small amounts, but I do not want to pay 900% of the original debt to a collection attorney who from what I've researched has 99.9% horrible reviews in regards to plaintiff's and defendants under them if they are breaking the law or just hunting for a victim to pay salaries.

FACTS:
Buying real estate from an estate. The decedent had filed bankruptcy and according to information given, the lien should not be good because 1) the debt was discharged and 2) the 10 year period is almost up.

The county records reflect the lien but no any filing for continuance for another 10 years. I have read this continuance had to be filed a year prior to the expiration.

We have now been told that the title insurance company is not going to reflect the judgement since it was dscharged.

My concerns:

The lien is still on there and would be after the sale if not removed. Does it automatically remove after 10 years or does the person with the judgement have to file something?

I was an international student last year. I have completed my 5 years in US,(as a student) so I have to file a resident income tax. My annual salary was expected to be 20,000 USD, so I couldn't had my spouse's health insurance covered. But, fortunately I was offered a job which I joined in the month of December. Unluckily, due to the last month, my earning came out to be 23,000 which is taxable. My wife is a home-maker. Now if I file the tax as single or married, do I need to pay the penalty in both the cases? (for the uninsured)

1. I have never had a business relationship with Capital One
2. I discovered on my credit report a credit inquiry from capital one in 2016.
3. I received a unsolicited credit card from capital one in 2016. I never activated the card.
4. I called capital one and talked with a rep who shared that capital one sends out unsolicited credit card offers.
5. Capital One never contacted me to verify my identity before sending the card.
6. Capital one sent a letter alleging that fraudulent activity may have opened an account
7. Capital one created an investigation number and said they would contact Trans Union to have the entry removed. It would take 3 months.
8. After three months the credit inquiry is still on my report.
9. Capital one sent a letter claiming that they investigated and could not find the credit inquiry on my credit report.
10. I pulled my credit report and the information is still on it. Trans Union says capital one never contacted them.

1. Capital one obtained unauthorized information from a credit report as defined by 15 U.S.C section 1681a(d)(1)

My question involves an injury that occurred in the state of: PA/NJ

Don't know how that works. I was driving my dad's NJ insured car in the state of PA and crashed into a tree.

2005 Cobalt didn't have ABS, place a stupid driver like myself behind the wheel and holy hell- the rear end locked up! An unmarked bend in the road came up and it was dark out with poor headlights.

Happened Oct 2015. Claim is still open.
I've had a surgery on my left knee. I can almost guarantee my right knee will need the same procedure done. I'm in the process of finding a different Ortho, I've lost confidence in the first one. My knees were documented at the hospital the night of the crash.



I've begun to question if I have any legal right to go after my parents car insurance for anything besides medical expenses. I can't run. Standing/walking too much hurts. I was 23 when this happened. I'm going to be 25 next month and some days, I feel like my life is 'over'. Work is hell, stairs are the enemy. I'm petrified to gain any weight because I don't think my knees could handle it. I'm only 110 right now but if I can't run, walk a lot or do stairs... I wonder how life will be when my metabolism slows down.


Part of me is asking because my sister got into an accident a few months before me and had a pinched nerve in her spine and had to have surgery. The other guy was at fault where as mine was just a single car accident.
But she's been seeing a lawyer and my sister seems to think she's going to walk away with 300k from a neck injury which makes no sense to me because she still runs. She's still active. Her recovery was a week long.


I don't think I'd be able to get anything more then medical but I figured I'd ask anyway. See if anyone had more insight on the matter.

July 1st, 2016 Chris and I signed a 15 month lease together.
I stopped sleeping at the apartment as of December 4th, 2016.
We argued all through November.

------------THE BACK STORY

One of those 'Omg, who am I living with?' happened. Initially, Chris didn't care if I decorated the apartment and we used my furniture and my belongings instead of his. He didn't care that I had the bigger room, my 3 year old son shared it with me. He initially agreed that I payed less in rent because I paid the electric, renters insurance, internet and I bought the food and cooked and cleaned.

Then, I got back with my ex. And suddenly, it was a problem that... well. Everything became a problem. All of it. He began bad mouthing me to my own coworkers- telling them over exaggerated, drama filled stories. These coworkers told other coworkers I work with it and I was bad mouthed all over Facebook. Chris would post things without using my name but I'm not stupid. This caused multiple issues for me at work and these issues still persist to this day.

Chris forced me out of the apartment before I was ready to do so. Initially- the move out date was decided by him to be Jan 10th, 2017. Two months time to pack up my stuff and find a new place.
But suddenly that wasn't enough for Chris, I refused to cancel my trips to Arizona over Christmas and I refused to cancel my trip to Jamaica at the end of January. He felt that I needed to cancel the trips because I needed to focus on moving out. Then it was 'You should probably sell your car, it costs too much.'
I agreed to move out because he threatened to leave the apartment and let me get evicted. (He could afford it on his own, I couldn't. My mistake there) He didn't care if this hit his credit report because he could just go live with his parents again. I didn't have such options. So I agreed to leave.
Chris couldn't make up his mind- Jan 10th soon turned into 'I want you out in two weeks.' And took the batteries out of the thermostat.

The stress from work, trying to find a place to live, and dealing with Chris's....outbursts got to be too much so I had most of my stuff packed up the weekend of the 4th. I packed my car up with what I would need and anything else I could fit in my compact sized car. I had an open invitation with the boyfriend.

Which is where I currently reside, with the boyfriend. It's been almost 3 months now.

I had a knee surgery which I haven't fully recovered from, the apartment in question is up a flight of stairs. Chris knows I struggle with stairs and carry things up and down them more then a few times will aggravate my knee. He already knows I'm physically incapable of moving my belonging by myself.
I have made three trips with the boyfriend, his truck and trailer and my car. I have made trips by myself with my car.

Most of my belongings are out of 'his' apartment. I still need to make another trip with the boyfriend and truck to get the last of it.






--------The ISSUE

I'm still on the lease. I cannot be removed from it. I did pay my share when I lived there. Chris created a hostile environment and I left because I felt I didn't have another choice.
But Chris has repeated threatened to throw my stuff to the curb if I don't come pick it up by such such a day.

Because I am legally still on the lease, and legally still responsible for the apartment can he continue to harass me like this?

I know I need to get my belongings out of there. I've been trying. I don't have friends or family in PA, I came from NJ. I don't have moving help. My storage locker isn't 24/7 and I work till 6. I'm only off one week day and I also need to work around my boyfriends schedule.

Honestly guys, I just need to know if I have any right to tell Chris to F**K off with his grade school threats legally.

My question involves a child custody case from the State of: Virginia

Prior to the divorce being finalized, my ex moved to Baltimore from northern Virginia where we both lived in separate households leaving me with sole physical custody. The divorce was finalized naming me as the custodial parent and grants her two hours of visitation on the first and third Thursday of every month and weekends as agreed upon, as well as including the standard move away clause that I must notify her of the intent to move. My question is on my chances at actually securing a move and what is likely to happen. We used to live in California before separation, where my family and support system still live. We moved out to Virginia for a job, but mine allows me to work from anywhere in the US and I want to live in California. I'm pretty sure my ex will object to my move if for nothing else because she doesn't like me. I know she doesn't really want to have sole physical custody, as she set the visitation schedule in the order, I had asked she see him more often and regularly but she dislikes schedules and gave excuses why she cannot commit even one weekend a month. I have asked her to take him for a weekend but she always declines these requests saying that she doesn't have time for him. The one good thing is that after I got sole physical custody of him, he has begun to thrive in school and after school activities just from having that consistency compared to when he was shuttling between our households. I've read that Virginia doesn't tend to favor relocation for custodial parents but they can't actually stop the parent from moving, only the child. I just feel depressed being stuck in Virginia and need to return to California for my sanity - my therapist offered to write a recommendation on my behalf attesting as such. How do you think the court would view this? I know they attempt to live up to the child's best interest standard and weigh financial reasons (going for a better job) over other reasons (sanity/happiness/mental health). I have always encouraged and promoted my son to have a good relationship with his mom, but it's unclear what would happen if I were to "force" the issue by choosing to move to California and let the court decide custody of the child or can the court actually stop me myself from leaving?

My question involves the fact that not too long ago that person X sent a picture of themselves with the caption "I am going to shoot up the school" now this person knowingly sent it to friends as a crude joke, however recently person Y got mad at person X and wants to show this picture with the comment to the administrators of person X. Would person X be able to sue person Y under defamation.

The peculiarity is that this logo will be extremely pixelated. So in short distances will be unrecognizable. Only from few meters will be possible to "recognize it". In any case, even from afar, reading it will be hard. As I said, the intention is just to "recognize it."

We are donating a substantial amount of items to a local thrift store. Valuation for these items for tax purposes is our responsibility. Not knowing how to value them, I got on Google and found this document from Goodwill: http://ift.tt/2lOlvUW

Hello all just wondering if this seems right to any of you and if you could tell me where the breakdown occurred?
My 6 year old daughter, was hurt on the play ground and sent to the nurse' the assistant principal followed her into the nurses office and in front of my daughter began to tell the nurse. How much she didn't like our family. The assistant Principal then began to push my daughter from the nurses office before the nurse was finished doctoring her wound. And she fell! The nurse called my daughter back in and told my daughter she was upset with the assistant Principal because she was mean to her. My daughter came home told me this!
Well I was angry and knowing myself instead of going to the school and jumping down the assistant Principals throat I called the sheriff to come talk to my daughter and go to the school and figure out what's going on.
They refused to come to my house to even ask my daughter or talk to me.
The next day the resource officer that works at the school brought me a no contact order, I can't have any contact with anyone at the school. And I never did anything other than całl law enforcement to find out if it possible that my six year old was just basically assaulted by the assistant Principal.
Anyway the resource officer asked the assistant Principal what happened she basically said hogwash. And got a no contact order against me. The resource officer did not ask my daughter what happened nor the nurse. I can't help but thinking that somehow my and my daughters rights were violated. As the sheriff refused to come investigate and the resource officer that works for the school was sent to investigate his buddy. Thank you in advance!

Car accident personal injury settlement received directly from third party insurance company because an attorney withdrew from case.

This was an ERISA plan from my spouse who was an employee for that company...I was just an dependent on her insurance.
Now my spouse even not working for that health insurance company for last 4 months.

Before attorney he withdrew he voluntarily said to health insurance administrator company that my client owes to 2k which in fact is not true because
settlement received was just a nuisance value ...at fault driver's insurance company did not pay medical costs connected to accident. So in my opinion
I don't owe them anything.

Now they are asking for 2k ...what if I can't pay them?
We don't have that health insurance coverage any more so we don't care...

Can they sell the debt to collection agency or they have to sue us and get judgement first ?
What else they can do to get 2k they think we owe them?:confused

Legal Malpractice: Attorney Withdrew from Case and Now I Have Dispute About Costs and Fees

My question involves malpractice in the state of: WA

1. Car accident personal injury claim.

2. Attorney withdrew from personal injury claim because he did not believe in our claim whole heatedly and did not want to try the case. i.e. he withdrew without good cause.

3. We settled directly with insurance company and settlement is quite more than he recommended and I could reduce subrogation costs to less than half.

4. Now he is asking for costs and fees and we don't agree to pay him any fees at all. Costs were about 3k and about 1k of this cost was due to his mistakes. We don't mind paying him 2k in costs.

5. If I don't agree to this what can attorney possibly do to recover his full costs and possibly some fees? What are the consequences for us if we don't have agreement and we don't pay him at all?

6. I believe he has to file a lawsuit and get a judgment against me? or he can directly sell it to collection agencies ? What else he or his law firm can do?

So im 16 and i live in California, i met this girl thats 13 and lives in Connecticut. We both like each other a lot and we've been talking for more than two months now by texting and video chatting literally everyday . i had talked to her mom twice and she seemed pretty chill and sounded like she liked me. Until one night were the girl i like tried to call me and so long story short her mom finds out she tried to call me and just starts going insane on my using quotes like "back the **** off my daughter" and "this isn't a real relationship". she also threatened to call the police on me if we kept talking. After that night her mom thought that we had stopped talking but neither of us could just end what we had over night so we kept talking until tonight where she got caught talking to me again. her mom called me started yelling at me and cussing again and just going crazy. She said that im harassing and stalking her daughter or something somehow which i dont understand because she wants she really likes me as well and wants to talk to me (but whatever, you can clearly tell that her moms crazy). So after all of this she said that she will be contacting the police tomorrow. Her mom is literally the one thats harassing me and she has given me so much stress. ive literally missed so much sleep and have had so many nervous breakdowns because of her mom that i dont even know what to do.

i was just wondering if theres anything here that i could get in trouble for and what will happen if she ends up lying to the them and giving them false information. Can i get in trouble if she lies to the police?

My question involves personal property located in the State of: Texas

Listed a $1300 generator on Facebook for sale in a trading post. On 1-30-17 a soldier/military policeman told me he wanted to buy it and asked me to hold it for him until his income tax was received. He told me it would be somewhere after 2-15-17. Due to him being a soldier and a military officer I agreed to do so.

As time went by he updated me every few days continuing to say he wanted it and that he was just updating me so I had no real concerns.

On 2-24-17 he told me his money had arrived and that he had my money for the generator but he was running late to work and would catch me that evening and asked for directions to my home. I had my son there to help him load it but he didn't show up.

I contacted him and he said he tried finding it but got lost and would pick it up Sunday (today). This morning he sent me a FB message saying he no longer wanted it because he was moving on base housing and they would not allow him to have it.

I have held it for him just over 3 weeks and believe he should pay for it.

I am wondering if he has an obligation to pay for it since there was a verbal contract/agreement even if that takes small claims court to achieve it.

Any suggestions/advice would be mostly appreciated.

Received three 1099c credit card debt cancellation from the same credit card company I use to have an account with, (dated Dec 31, 2016),
and that dates it passes the 36 month testing period according to IRS; they send it after 51 month from last delinquent payments as reported
on credit report year 2012.

My present credit report is clear, no bankruptcy, no judgments, and all other credit accounts been removed from collection and from my credit report.

Preparing worksheet of insolvency:

--Can the total amount of the other delinquent credit card accounts be included in the liability, along with the above motioned 1099c ?
“Although these other accounts been removed from collection and does not show on my credit report any more”.

--If these accounts can be included in the worksheet under liabilities, will they reactivated for collection again, since i haven't received the
1099c forms for them yet ?

-- Does the IRS consider a paid off living home as an assets vs liabilities?

My question involves a traffic ticket from the state of: WY
I got a speeding ticket at WY last year. Municipal court judge found me guilty. I appealed in district court. The town filed a notice to non-participation in the appeal and did not showed up in the appeal court on the appeal court day. My reasons of not guilty were:

1 I was traveling East not West as the ticket indicated, (travel direction)
2 The location was listed at the ticket was not correct. There is no such location in the town. During the trial, Officer could not point out exactly where her car parked when she found my car.
3 During the trial, Officer testified that she followed my car 1.2 mile before I stop. Based on the location where my car stopped, the event happened at the location was not the same as the ticket indicated.
4 Office’s daily log showed the time did not match the ticket time.
5 Office's Radar calibration log only has one day’s record without handwriting input of numbers.
6 Office’s training record showed that she only have 8 hr total training of using Radar gun instead of 24 hr class and 16 hr field training
7 Office’s testified that VIC listed on ticket indicated construction zone while Judge explained as Superintendent Zone. I got $140 bond which nobody could explain to me how this number indicated from the Schedule.

I presented all the evidence for above as exhibits in my appeal document.

However, 4 month after the appeal day, district judge issued the order with the conclusion of "the municipal court is affirmed"

My questions: Appellee did not response appeal nor appeared at appeal court, still he won the appeal? Why? All my reasons above were not enough to change judge's mind and judgment. What should I do next?

My question involves civil rights in the State of: Maryland. My husband and I were shopping in Home Depot for about an hour maybe a little longer. We were finally ready to check out after a cart full of items, we went to one of the self check out lanes and began ringing up things. We noticed an employee literally over our shoulder and walking back to the screen. It was so uncomfortable when we were walking out we noticed I had rung myself up one too many blinds. We went right to customer service, showed two employees and explained to them how uncomfortable that employee made us. While we were standing there having them count the blinds and check out our receipt we noticed we forgot the hook to hang the plant. we asked the employee do we leave our cart or can we go get it. She said you have your receipt they're your items you're fine. We walked to aisle 17 made it to the Top of the aisle and we were chased by a manager screaming you can't take that cart down there. I told her we have our receipt, we were told it's fine and she embarrassed us in front of so many people. I went back to customer service after being embarrassed, had nasty comments by other employees said about my husband and myself I asked for corporates number. My husband went out to the car while I went to get the ladies names who treated us terribly. I asked her for her name since she covered her name tag when she seen me walking towards her. She kept asking why why. I told her I wanted the correct names to report to corporate. I let her know she discriminated against us, embarrassed us and let her know her actions were unacceptable. When I told her I was calling corporate she threatened me with loss prevention. I told her please call them so they can show her she's out of line and here's my $200 paid receipt!! What can be done about this?

I want to find out what counts as a "day" toward the home residence requirement. I am in a unique situation in that I live adjacent to the border of Canada and the United States. My husband is American and he can't be living in Canada for his job. I want to know whether I have to be in Canada for 24 consecutive hours to count as a day (toward my two years), or if I could be in Canada for a small portion of the day and then visit my husband in America and have that still count?! I can't find any clear information as to what would count. Can anyone help?!

I was told that my company no longer was able to be contracted to work at a large property based on the actions of my employee who suffers from bi polar.

Last week he complained to the security management about the practice of dropping off an ID for roof access to do a job he has been doing for 4 years. He was not loud or threatening but confused. The owner of a large janitorial company (Joe) called me and told me that he didn't want my employee returning to the property (Joe subs out specialty work to my company). I went to the security office and apologized to their management team and explained that my employee had bi polar anxiety and that I would not bring him back again.

I then texted Joe and explained that the employee doesn't understand he was making a problem by questioning the ID protocol. And told Joe I wouldn't use him there anymore.

Joe asked me into his office the following day wanting my help cleaning up some specialties before an owner visit to the property upcoming on Monday. I told him we couldn't finish the work we started until Friday unless I brought back the employee and have him complete the job over the weekend. Joe told me to bring him.

Over the weekend while I was in vegas I get a call from Joe's manager telling me my guy wasn't allowed unless I checked him in with security. I hung up on the idiot and proceeded on with my weekend getaway.

Tuesday I get back and check our man in and have him gain access to the roof. A half hour later Joe calls and tells me my company is 86d from their no longer allowed on property! This cost me about a 100k in contracted income. I'm not concerned about the money as much as I am about the principles here. Was there any discriminatory violations in my scenario?

Contractor Damages Common Area, Am I Liable

My question involves a consumer law issue in the State of: Maryland

I had a contractor install a concrete patio in my back yard. I have a town house. The contractor, unknown to me, drove a cement truck through the common area to reach my back yard, leaving deep ruts in the ground, and in some areas destroying the grass. This contractor worked on two other homes adjacent to mine and the workers used a wheelbarrow to pour the cement, that is what I thought they would do with my patio. I was not present, had I been I would have stopped the truck from going through the common area. Now my HOA is upset with me and wants me to repair the damage.

I had the contractor try to repair the damage, he tried twice. Neither was satisfactory, both efforts were pretty lame. My question is am I liable for the damage to the common area from this contractor's negligence? I didn't tell the guy to haul a cement truck over soft ground (it had rained just prior to the work), and I certainly never would have allowed him to drive a cement truck through the common area. I am willing to sue the contractor, but shouldn't the HOA sue the contractor instead of me? Should we jointly sue him?

My question involves a child custody case from the State of: I have a few questions in regards to child support and really need some advice. So I am currently in a battle with the non custodial parent and NC Child Support. In court the non custodial parent states that he is currently seeking employment but has been seeking employment for the past 8 months. Mind you, we've been to court 3 seperate times with the same lines and excuses but all the court does is move our case to a later date since he has no job. Though when I talked to him outside of court he claims that he is not trying to find a job because he is currently paying child support elsewhere and knows that if he did have one that his child support will go up. He doesnt want to have anything to do with our son and seems as if he isnt taking the initiative towards his well being but I do have documentation that he has been going on trips and even paying for certain memberships such as the gym but can not pay for child support. Which is only $55. BARELY NOTHING AT ALL FOR A 1 YEAR OLD. Now when I talk to our case worker all she says is that she has been staying on him about getting a job and tells me that the above information I gave her cannot be used in court because he is not using taxable money???? Then she also told me on our court date before last that if he didnt have a job by the court date (which has passed) then the court would force him into a father's program where he would have to work. But then tells me at the next court date that he wouldnt be considered for the program because he lives in a different county. So why even tell me that that would be an option. She doesnt communicate with me and its pulling teeth just to get in touch with her. I dont want to be on the emotional roller between the court and him so I just need help on what I should do.

Im about to be 16 here in a week or two and im thinking about getting emancipated but I am not sure if my reasons are valid enough plus i know i won't have parental consent for the emancipation. The reasons I want to get emancipated mainly have to do with school and home, I live with my sister at the moment but im going to have to move back in with my mom next school year and when i do, I know it will result in a huge fight with my dad. Ive been moving back and forth from place to place between my parents for at most two years now and then i moved with my sister this last summer and school year. My dad is pretty much mentally abusive and believes that he pretty much owns me untill I am out of school, my sister on the other hand has gotten to the point where she belives she is my monther now and it has been causing some pretty bad problems. My and I have been getting along alot better recently but im still sure that living with her would be a good idea. The thing with school is that I am pretty much failing and i am finding extremely hard to catch up and keep my grades up, I try getting help when it comes to subjects I stuggle in such as in math but getting help is extremely hard because I have to rely on my sister or my mom or whoever im with to help with things such as Transportation to my teachers house or getting things online that would help, and because my grades are low my sister won't let me get a job when i turn 16. Ive been wanting to get emancipated for a while now mainly because I just want to settle down and be able to have control over my life and opportunities. I want to get my own bank account and savings account so i can start saving money for college or a vehicle, also another reason i want a job so bad is because I want to be able to have a way of making money to save, plus I want to be able to have money for things that would help with school such as tutoring programs and online help. I know having and getting a job is not easy and i know I will probably hate it but thats just a part of life. I feel like I'd be better on my own because then I could choose where i live and what school I know I will do well in, plus i wouldn't have to worry about moving around so much or having to base everything I do on someone elses terms. If i had a choice i would have had a savings account a long time ago, would be looking for jobs at the moment, would already have my driving permit, and would find things that would help alot with school. People tell me to enjoy being kid for as long has i can but because of what all I've been through, Its gotten to the point were I can't mentally deal with being a kid. Not having a job or savings account or not being able to make my own decisions on things that effect me as a person is extremely stressfull. I kinda feel like an adult who had everything they had taken from them and is now being forced to live as a kid again if thats a good way to explain it. I know that if I do manage to get emancipated that I would be capable of getting a place to stay along with health insurance, car insurance, etc. Will i be able to get emancipated even though i don't have a bank account, job, or parental consent ? my step son bought a jep off facebook. we went to pick it up.
lets say person a is the name on the title.
person b is the seller we are dealing with.
person c in my step son.

we get there and the jeep is well worth the money.
B writes out a simple bill of sale. both B& c sign it

B then hands the title to C.
he looks at the title and finds out B is not the owner
A is the owner B never put the jeep in his name. the back is
filled out. A signed the jeep over to B.

C takes all the paper work to the tag office to have it put in his name
He is told that he has two things he can do.

1. get a temp tag and try to get the paper work done a T-11 from the person that owns it which is person A.
2. get person B to do the title work they started.

so now we are trying to get this paperwork do.

we contacted A. sure what ever you need. A now lives in Indiana.
B sure what ever I need to do just let me know.

So C is riding on a temp tag and has 3 days to get something done.
NOW A OR B WILL CONTACT US!
so now does any one know how to by pass A& B and get the title work done? we can get 1 more temp tag ( maybe]

-My son will be 18 on the 26May2017, my question is am I still obligated to pay child support for him when he turns 18 even if he is currently attending job core? He has been attending Job Core since Nov-2016 and has not obtained his high school diploma yet.

-If I'm not mistaken technically he is no longer living with his mother, he is receiving room and board through the government, shouldn't that with-in itself terminate child support?

-How can I go about getting more information regarding this situation?

Car is in My Name but She Pays for It

My ex has a car in my name that she pays for and pays for the insurance. I made her sogn papers stating that if anything were to happen to it she would be responsible for it and when I had a restraining order on her that I dismissed with a different judge, the judge that wrote the order stated if she didn't pay for the car she would be held in contempt of him until the car was paid for and I gave her the title. If I wanted the car back, could I take it back without having to pay her any money? She was violent towards me which got her the order and has a history of violence. My question involves a marriage in the state of:CA

My spouse served me with initial divorce papers, just the basic paper and for all components (child custody, child support, etc...) each section said TBD, to be determined later. He used a business that completes legal paperwork, not an attorney. He did this in April of 2016. Since then he has refused to complete any other paperwork, since he initially filed in order for me to say my side I did a respondent answer and requested fees waived. I missed a court date for the fee hearing and so the court didn't accept my response. However my ex never completed the financial disclosures, property disclosures etc...

yesterday in the mail i got a paper from him, filed for a default divorce. How do I show that he never provided me with any disclosures and how can we get a default divorce when everything is TBD, to be determined...


at this point I dread I need to get a lawyer because all of the paperwork he has filed is incorrect however the courts continue. I am able to show I did file a response however due to a technicality is was rejected and he nor the business has served me with any of the other items.



What steps do I need to do to contest the no fault divorce... thank you for any assistance.

My question involves a child custody case from the State of: SC. My question is can a grandparent be granted visitation when the dad is denied visitation by the mother. The grandparents have relationship with the children, often children lived in home with grandparents. The mother threatens to keep children away from grandparents if children see or speak with dad. I don't know how to handle this situation but I can't conceive of thought of never seeing my grandchildren again.

Liens and Encumbrances: Selling an Older Mobile Home As Rent to Own with Lien Placed on Title

My question involves real estate located in the State of: West Virginia

I'm selling an older model mobile home to a buyer paying a down-payment and then monthly payments until paid off in full. Per the trailer park rules & regs. the title has to be in the new buyers name to stay on the lot, so I need to place a lien on it.

What is the best way to legally go about this process to protect us from non-payment? Can I include a clause in a document signed by both parties that states if buyer fails to make on-time payments, they forfeit any funds already paid and are subject to eviction?

I cannot find any information online about how this process works to create the lien safely and/or how one goes about reclaiming the trailer if the buyer does not pay. Any help is appreciated!

My question involves real estate located in the State of:CA

During January we had a few big storms here in Fullerton California. During one of the storms the big street tree owned by the city fell on top of a car parked in front of my house and totaled it. I called the Fullerton PD to see who is responsible and she said the city is if it is in the parkway. A city worker came and assessed the situation, the Fullerton CSI took pictures, and the city arborists cut up and took away the tree. The police told us the car owner needs to file a claim with the city. He did so and after waiting about 30 days they denied his claim saying it is an ACT of GOD the tree was healthy. He has full coverage car insurance and they also denied the claim because it was an ACT of GOD. I rent his house from a relative so I asked them to find out from homeowners insurance if they will cover the totaled car. The homeowners insurance told her they do not cover vehicles.

The last 3+ years Ca has been in a drought so the city only allowed us to water our yard 2 times a week, The tree was still very green and healthy. I believe the tree roots became weaker because of less water and during the storm the ground caused soggy soil causing the tree to fall.

I would believe the car would be covered by at least one of them....ther city, car insurance, or homeowners insurance. Who is legally responsible to pay for the car that was smashed? Please lead me in the right direction. Thank you!!!
