My question involves criminal law for the state of: Florida
Hello,
My 23yo stepson was arrested last year and charged with burglary and criminal mischief for punching a window of someones house. He had a PD and ended up settling with the state for 3 years felony probation adjudication withheld. Well, he completed all of 3 months of his 36 month probation and got pulled over after curfew for running a stop sign. When he got pulled over the sheriffs deputy seen he was on probation and arrested him for being out after 10PM.
Here is where it get stupid. He is placed in the patrol car in handcuffs. Then the officer decides to open the door so he can see his 3 month old son before he goes off to jail. Well he decides to make a run for it. Somehow he got the handcuffs off in the car and when the officer opened the door he bolted. During this process he allegedly run into the officer knocking him to the ground etc etc etc.
So, now he sits in jail with no bond. They charged him with battery on a LEO, resisting w violence, resisting wo violence and ESCAPE custody. Now this kid has been a screw up for most of his life. He's not the brightest bulb in the tree but he's not the dimmest one either. Since I am married to his mother this is affecting both of us. I am the only person in a position to pay for an attorney, however, I am not quite sure that is the right thing to do at this moment. However, I do not wanna see the kid getting 5 years for punching somebodies window.
So my question is as follows: What is the best case and worst case scenario for him?
