My question involves court procedures for the state of: GA
Purchased an appliance on-line. Delivery company damaged front stairs and porch. Delivery compnay has a formal complaint process involving photos, description, three estimates and an affadavit. The damage is conservatively $1800.00. I complied with their claim process. Their response is that "I have to sue them". Delivery company hired by appliance seller. Delivery company BBB rating of D. Delivery company home office NYC and local office Atlanta GA. Damage occurred in town 50 miles from Atlanta in different county.
Questions: where do I need to file in small claims court? Can I sue for collection efforts? If so, initially or later if/when trouble encountered?
