Child Abuse: What Does It Take to Get CPS to See Children Need to Be Taken from Their Mother

My question involves child abuse or neglect in the State of: Virginia

How much does it take before CPS will take children out of a home when their mother is proven to be a drug addict?
This is a really long story but the short of it is that since the last week in March the mother has been under investigation and failed numerous drug tests, even one as recent as first week of June. The mother doesn't have a job and has made no attempt to get one. shes currently under investigation with the food stamps program for claiming her oldest child when that child hasn't lived with her for a year.

Is it easier for a dad to get full custody if there is an open CPS case?
The father really wants full custody but is afraid that because he technically violated a court order and because the mom is being "treated" for her drug problem that they wont award him custody. The court order he violated has been dealt with and he avoided jail time. He lives in Texas and during is last visitation he kept the kids longer than he was supposed to because of the allegations of drug use and abuse in their mothers home. He did it legally, I believe the judges exact words were he "legally hijacked" his kids. He got some bad legal advice from an attorney he obtained in Texas. He had one in Virginia but right about the time he got his kids his attorney fell ill and nearly died. Now he has a much better one in Virginia but at the hearing for the violation his attorney didn't think it was a good idea to ask for full custody.

Everyone seems to be on the right track now but the son has completely shut down and wont talk to his therapists about anything. Hes really terrified of his mother.

Is there anything this father can do to help? Is there any point calling CPS when his family in Virginia says they have seen local drug dealers at her house or seen her leave the kids at home alone and returning a couple hours later barely able to walk? Seems the only thing CPS has proven is that shes is taking drugs, the kids wont talk about anything to prove the other stuff and CPS can't watch her 24/7. The father has loads of stuff from the beginning of the year when his attorney advised him to hire a PI to watch her to catch her in the act, but the current attorney said its not relevant? How is that? Its like the violation has erased everything anyone did before the court date for the violation. Except of course that CPS is monitoring the mother for drug her use.
