Education Law Issues: Daycare Will Not Release Child During Tornado Watch

My question involves education law in the State of: Kansas

My son's daycare would not release our son to his grandparents during a tornado watch. The grandparent is an approved person to pick up the child and does so frequently without issue. The grandparent lives 40 feet from the daycare property. During a tornado watch we called the grandparent and requested that they pick up the child and take them to their basement. The daycare refused to let our son leave with the grandparent. Several other parents were also advised that they would have to wait until the watch ended before they will release the child. Is there a reason legally an approved adult could not take a child out of daycare during such bad weather? Can the daycare file any charges?
