My question involves labor and employment law for the state of: Colorado
I got an offer for a public finance position at a bank. I am currently filling out the FINRA U4 form and have an inquiry about a question that says "Have you ever been charged with a felony?". I was a victim of identity fraud and was arrested coming home from a flight (quite surprised when it happened) and had to go to court for a felony. The case was obviously dismissed and I had the arrest record sealed. What would be the correct way to answer the employment question above? I've heard that FINRA has access to the FBI databases in which case a a sealed case will still be able to viewed if the FBI has not removed it. Additionally ill the fact that it is a public finance position (because of the government association) cause me to have to answer the question differently? Thanks all.
