My question involves criminal law for the state of: West Virginia.
Two of my friends, both above the age of eighteen (we'll refer to them as Girl A and Girl B), ended up walking into a K-Mart chain store and stealing some makeup and other items.
After Girl A started feeling anxious, she kept some of the things but put other things back and was directed to put some of the makeup they had stole in Girl B's purse. They exit the store and as soon as they exit LP (Loss Prevention) steps infront of them and instructs them to go into the back room, knowing that they had stole some items.
They go into the back room while LP tries to figure out the amount of cash the goods were that were stolen. Girl A stole an amount of goods that was worth $14, Girl B's was $40. They were all in Girl B's bag, though. Girl A had explained what items she stole, and Girl B explained what she stole out of the entire pile.
Police arrive on the scene, yell at Girl A and Girl B, but they don't arrest them.
They both recieve a citation on the spot which has a phone number on it that they can call, to figure out the amount of the fine (?).
Girl A and Girl B are sent on their way. This is their first offense shoplifting, and their first offense for any criminal actions in general. They don't have the money to pay for the fine, thinking that it's around $250. What will happen if they don't pay the fine, and will they face possible jail time if they don't?
