My question involves paternity law for the State of: GA (birthplace due to military)
I had an affair while my husband was in Kuwait with another married soldier. I got pregnant.
My husband finished his deployment and I had to put his name on the birth certificate as he was presumed to be the father even though he was not here for conception.
My husband has accepted responsibility for another mans child and sees her regularly, wants his rights to the child but I want money. bio dad makes more than legal father.
My daughter (child in question) is now 2.5 yrs old, will be 3 in may.
I went through the state of Arkansas to try to get child support from the man who is her biological father but it was dismissed in court.
what happens now, can I take my husbands name off of the birth certificate and go after her biological father again? do I go after my husband for child support? we are married but living separate.
is it too late to amend a birth certificate? and can I do it on my own without any other parties involved?
edit: now that you have read the story above, know that is not actually my story. I am the wife of the man who is supposedly the biological father. the case against my husband was thrown out. I need advice, not to be patronized please if you can avoid it. I do not know yet if the ruling will be with or without prejudice against her. I am hoping it will be with but until then, I am just trying to stay one step ahead for my family sake and for the sake of the man who is not her bio father but wants to continue being her father. legal dad, my husband, and I communicate regularly. the mother is vindictive and all she wants is money, she is now pregnant by another man (if that tells you anything about her character)
thanks in advance. if needed, my husband and I are residents of Arkansas and legal father is a resident of Missouri and was while in the military. only mom has ever been a resident of Georgia and alabama but with so many places involved I do not know what states laws to look up.
