My question involves criminal law for the state of: California
I was at a friends place drinking. We came out to my car to smoke my medical marijuana because her mother doesnt allow us to smoke indoors. We were sitting in my parked car , keys in my purse, when the police arrived.
A neighbor had called the police after seeing us sitting out there smoking for so long.
They police told us about the neighbors complaint and then minutes later tried to say he followed me. I told him I was staying the night here and that he didn't follow me from anywhere. I passed a field sobriety, they searched my car over and over before arresting me, taking me to the station and taking my blood without consent .
Now I am facing a 2nd DUI charge. My last DUI was 4 years ago.
Do I have a fighting chance to remove the DUI charge? Isn't there a lesser or different charge I should have received?
A close friend said I will be wasting time and money fighting it..
