My question involves criminal law for the state of: new York.
2 months ago my ex and I started dating and she left her boyfriend and father of her kids, when she left she moved in with her step mother.
Her ex found out where she was staying and assaulted her but charges were not pressed. After he found out about her and I, he tried to find out who I was, but was unsuccessful. He has sent her messages saying that when he finds out who i am, "he is going to **** me up and **** her up too." I also have that message saved but I haven't made any type of report or anything like that.
Well he figured out who I am and what I drive etc, so my question is if he assaults me do I have the ability to press charges? Also what would happen if I fought back, can he also press charages? A friend of mine told me that he can press charges even if he hits me first. And what are the exact laws pertaining to self defense in this situation? Thanks in advance for any advice.
