My question involves child support in the State of: TX
Going to try to make this short and to the point. Forgive me if it isn't. Better you have a lot of information than none at all.
We are under the basic custody agreement the attorney general gives you when you are put on child support, that was in 2009. My step-son has been off Medicaid since June 30, 2015. We found out he was off of it by the receptionist at his doctor's office when I brought him to an appointment, in July this year. He'd been on it since he was a year old. From my understanding, the only reason he isn't on it is because she didn't renew. Well we talked to her about it in July, when we found out he was no longer covered, and she said it was a mistake because she got a paper in the mail saying he was on Medicaid. We asked for a photo of this paper and she never provided it so we paid out of pocket for that doctor visit. We asked that she cover some of the cost, she didn't. Fast forward to September, he was at a playground with his grandma (her adoptive mother) and jumped off a scooter breaking his arm at the elbow. This time she admits he isn't under insurance but claims he had been and that the only reason he wasn't at this time was because Medicaid messed up his coverage so now she has to reapply so his medical bills could be covered under Medicaid. Provides no proof of any of this. Now 3-4 weeks ago my stepson began complaining about his spacer that keeps the surrounding teeth from closing on the spot he had a baby molar removed in April 2013. I took him to that appointment and made a new one for November 2013, he has to go back every 6 months to resize the spacer. His mother knows this and said she'd take him to his first 6 month appointment. Well she never did take him to that one or any other one since I took him to the first initial appointment for the spacer. I found this out because I called the dentist to try and schedule the next 6 month cause I was just going to take him and they told me he had not been to see the dentist for any 6 month appointment. At this point, he should have gone to the dentist at least 4 times. When we confronted her about it, she claimed the dentist office messed up and lost the records. I called the dentist office and got his dental records and written in their notes is that she called them, after we asked about his dental needs being neglected, and she told them not to release the records to us. Now the spacer is cutting into his gums so I wanted to make him an appointment for the dentist next week while we have him so I texted her asking if he was on Medicaid now. She never answered me, so I just decided to call Medicaid to find out for myself and to ask for our own insurance card which she is required to provide to us, yet never has. Turns out she has made no moves towards getting him back on Medicaid. I did read the health insurance part of the custody agreement and it states that she (the obligee) is required to always have him covered under insurance but she isn't doing it. So my question is, if we file for him to get Medicaid through us, will this affect her child support or our custody agreement? At the moment, we're not trying to change anything, our goal is just to get him covered. We can't afford private at the moment so it isn't an option.
