Dismissal: How Can You Proceed With a Case After the Statute of Limitations Runs

FACTS: (NEW YORK) Lawsuit was filed against state entity after the statute of limitations ran as to suits against that entity (statute setting forth that they must be served within a certain amount of days).

QUESTION: Are there ANY excuses which could be argued to potentially allow the court to order that the action move forward against the state entity even though commenced late?
