Determination of Fault: [Washington] Traffic Accident in Intersection, Need Help with Determining Fault

My question involves a traffic accident in the State of: Washington

My wife was just in an accident in an intersection during heavy traffic. She was stationary behind a car in the middle of an intersection when the light turned yellow. Realizing she would be blocking oncoming traffic from the other lanes she proceeded to change lanes to the right to get out of the intersection. At the same time a BMW coming from behind in the right lane sped through the intersection clipping the front right corner of her car and scraping the left side of the BMW half way down. Based on the damage it's obvious she was essential stationary in the intersection while the BMW (I can only assume was attempting to beat the red light and not paying attention) sustained more damage all along the left side of his car. I think the fact that the BMW either ran a Yellow or Red light and that my wife was in the intersection first places the fault on the BMW. Unfortunately there were no cameras to show what the traffic light had at the time but the officer cited her for not yielding to right of way, which we intend to dispute later in court.

Adjuster won't be able to contact till after Christmas so we have no idea which way it is going to swing.
