My question involves criminal law for the state of: Travis county Texas.
Female friend of mine 'had it bad' for the ex of 10 months that dumped her. She kept calling him, txting him, etc. He finally gets a stalking charge put on her. Prior to this her nose was completely clean.
The charge hasn't went court yet, but had a protective order put on her. And she violated it multiple times with txts, phone calls, etc. During the protection order, he asks her to come over to his place 'and bring beer', for some intimacy. Later that day, he's giving her instructions on how to go see his band play that night, which she does.
A few weeks goes buy, they get into another tiff, and he calls the law again - and now she's in jail again for multiple violations of the protective order. No-one has money to bond her out (she's been in for 41 days as of tonight).
My question is, what do you think the outcome will be? Probabation? a few months in jail/prison, or perhaps even a couple years? Now, I know it's very easy to say, "it's too hard to say"... but, if you were on the fence, and based on previous knowledge, which way would you tend to fall?
Her current attny is a 'friend of a friend', and was only paid $750, and her attny (it appears anyway), is taking this as a side project, and acting that way too (of course she would, considering she's not getting paid - or hardly paid to do this). Her attny is currently getting psycological exam reports from psycologist, where the jailed friend was shown to have depression, OCD, and a few others, can't remember right off. This is what her attny is working on right now, to get her out for a mental problem.
I guess, all in all, I'd like to know what's the chances of her doing actual time, considering she's never been in trouble before, and there was no violence, etc. Only the ex-boyfriend say, "I'm in fear of bodily injury, and I'm in fear for my daughter". No violence actually occurred, so there's no evidence there. I know this girl, and she's just this love struck woman that cries at night because her boyfriend dumped her, and she doesn't know how to move on.... then this guy calls the cops on her twice because she's constantly calling him, trying to get back with him.
