My question involves public health law in the State of:
If one has medical records for mental health related concerns, are these records kept private just as any other medical record? I would have assumed that they would be, and as to what I have read on the subject they are. However, could an employer ask for access to a HIPPA protected record(s) of any kind, mental health or not? I have been struggling to find information on the subject. If someone is hospitalized for a mental health condition, is that HIPPA protected as well? Would that be visible to employers, and would they have access to this information?
