My question involves criminal law for the state of: Arkansas
I was stopped for improper lane change, then, after the officer smelled alcohol on my breath, he arrested me for a DWI. Still waiting on the blood test results because the breathalyzer machine at the PD was not working, and the officer did not have one on the scene. I was cooperative and admitted to drinking wine with dinner. The officer informed me I would have to stay a minimum of 8 hours in jail. This was around 10pm. In the morning, I was booked in and right before the jailer took my photo, another police officer took pictures of me with a smart phone. At the time, I thought it was strange, but I assumed it was not his personal phone and he did this for some reason for the jail. Several days later, my boyfriend's ex-wife stated she received a call from a "friend" saying she saw my mugshot. She said she did NOT see it on-line (I know it's public record), but that a friend sent it to her. I have notified my attorney who stated that should not have happened (the pic being taken). Does anyone disagree...agree...can police officers take pics of detainees and send them to friends from their personal phones?- Thx for any feedback. Please no shaming me about a DWI..... no evidence yet that I was legally intoxicated & I've plead not guilty.
