Hello... My aunt and uncle were hit from behind as they were exiting the freeway and my aunt was injured (26 stitches in her head, sore back/neck, etc.). As my aunt was being treated at the hospital, a policeman went up to my uncle to get his statement. He told him that there was a witness who stated that he made a late lane change. My uncle is aware that he did get over late, but he says it was clear and he was completely in the lane before being hit. They were rear-ended smack in the middle of their Honda - not from the corner or side - and it appears at a high speed. So, I am wondering, are they able to seek any damages? My aunt was seeing a chiropractor and their car insurance stopped paying recently and she can't afford to go anymore. In the beginning, their insurance called to say it was 100% the other driver's fault, but a week later their story changed.
Do they have any recourse considering that there was a witness?
