Student Speech Rights: Cellphone Confiscated Unfairly

So here's what happened i was using my cellphone during recess in the cafeteria not even the class and all of a sudden the deputy director comes up to me claiming that i am breaking rules and before i can say anything she snatches the phone from my hands and takes other students phones who were nearby and leaves later during the day after school i go to her office along with a couple other students who had theirs phones confiscated in an attempt to get back the phone however she forces us to leave before listening to what we have to say and informs us that she has no intention of returning our phones to us as bringing the phones themselves is against school policy so what i do is after i get back home i decided to look up the school policies on the school website and am shocked to find out there is no rule regarding the use or bringing of cellphones or any other electronics.

Now before u judge me saying that i'm overreacting and they will give back the phones later after calling us to the office maybe a day later or even a week i would like to point out that she has no idea who we are our names, classes or any personal details neither has any attempt to identify us been made and the lack of interest in what we have to say or even when we can get our phones back how many days, weeks, months etc has led me to believe that this is a permanent confiscation of our belongings and as i have read that is illegal for any school to do and that is ONLY when it's stated in the school's policies which it isn't.

So can this be counted as theft?
Can i take or any of the other students who have had their cellphone confiscated take legal action?
