My question involves a traffic ticket from the state of: Washington
So i got a ticket for going 60 in a 45 up hill and not via radar or laser. The road is windy and uphill and I got my ticket at night
It was sunday at 6:22 after a Seahawks game. I was driving my Camaro and we went to Taco Bell because Jamie (fiance) was craving it. Again, 6:22 in November, it's dark out. I was coming up a hill, maybe 2-3 miles from my house. I was probably doing 45-50 or so in a 45 MPH zone and i see these headlights behind me like coming up fast. I even say to Jamie, "this car behind me has to be flying", again checking my speed and I was probably 45-50 or so. I used to live right off this road so very familiar with its twists and turns. From the bottom of this hill to the top is 1.5 miles, and elevatation of nearly 600 feet, with three large distinctive curves in which site lines are lost. Again, this was at dark, so all he had was my tail lights to view, and I see this scenario solely as him catching up to issue me a ticket because he "thinks" I was speeding because he never was behind me for long enough to pace me, and when he did show up behind me, he hit his lights immediately to pull me over.
I lose sight of his headlights behind me as I turn around a bend that curved to right right and begins an uphill decent to the crest. He comes around the bend and is much closer, but still probably 1/4 mile behind me. I keep up the climb the hill and when I hit the crest of the hill, his headlight drop out of my view again until he makes the crest. He then hits the crest, hits his lights and pulls me over as we are about to cross an intersection. Just past this intersection the speed limit turns to 35 (but we hadn't hit that sign yet), but I know this, so as I hit the crest of the hill I begin to slow down as it gets a little more residential.
I honestly thought he was going past me in a hurry. Nope pulled behind me and hit his lights. He comes up asks for license and registration and doesn't ask for proof of insurance at all.
Peeks in my window and says something like "I had to be doing at least 80" which was a complete and udder lie. Jamie at this point is about to start talking over me from passenger seat when I tell her to just chill out and relax. He goes back, spends 1 minute or so, again doesn't check my insurance, and comes back and says he is going to cut me some slack and gives me 60 in a 45 for $156 ticket.
However, I decide to contest this ticket because, he at no point, could of been pacing me because of the turns, elevation, darkness, and lack of him even being behind me for any sort of time warranting a "pace".
With that said (and with some reading on this forum), it seems I may have slipped up subpoenaing the officer to attend my hearing. I figured that was my only shot at getting a dismissal on this, otherwise it is his sworn statement (in terms of his discovery and notes on the ticket) versus my word, in which I thought I would have a 0% chance of success.
So, with what I have described, what would you think my best opportunities are? Sorry for the choppy description, I copied and pasted from a conversation I had with my father via text. I'm happy to provide any other additional comments as well.
