My question involves property rights in the state of: Arizona
Hi everyone. I'm looking for a bit of advice. My relationship with my fiance ended a year and a half ago. It was an 8 year relationship which I ended because of abuse.
During the course of the relationship my ex and I bought a car.
He paid cash for the car with a check.
The car is titled in my name only. The sales contract is in my name only. The registration is in my name only. He told me it was a gift several times during the course of the relationship. After we broke up he told me I could keep the car.
Fast forward to the present- I still own the car. Since we've been broken up he has stalked me, pursued me over text and phone to get back with him. He figured out where I lived and worked (saw him following me) and sent intimidating emails overtly threatening me if I wasn't nice to him and did not be his friend, emails saying he sees me around town and knows where I go. He got a tattoo, inspired by my face on his arm (yes, my face is on his arm) 6 months after we broke up. His brother sent me a picture of the tattoo.
I was very scared and did not want to file a restraining order as it would only excite him into anger (history of violence).
The past year and a half has been on pins and needles, anxious, stressed with him not leaving me alone.
For my safety and my childs (not his) I relocated recently, unbeknownst to him. Tired of his continual emails asking to meet him/cursing me out/professing his love-hate for me, I firmly told him, on email, that anymore communication from him would result in me filing a restraining order. I explained that he scared me and the things he does are not what normal people do. I just want peace and to not look over my shoulder anymore.
He then replied and said "Good luck filing a restraining order, just for that I am suing you for my car. It's MY car not yours. Im going to make this my new hobby" He gave me until Friday to return the car or his attorney will draft papers.
Can he win a suit against me for my car? He doesn't know where I am but he is wealthy and has time on his hands.
There is a statute of limitations in AZ for real property, does my car count?
Any advice you can give if he does indeed sue is much appreciated.
