My question involves real estate located in the State of: Oregon
The easement through my property is NOT being maintained by the dominant tenement (Administrator) per the easement agreement.
("2. 1st parties shall have an equal right of ingress and egress over and upon said above-described roadway, but 1st parties shall be under no obligation to maintain or keep said roadway in repair.")
The owner/administrator of the estate lives on the East Coast. The administrators nephew is living in the home and paying rent to the estate/Administrator. May I sue the nephew to enforce the easement maintenance agreement or must I sue the administrator which would mean traveling to the East Coast!?
