My question involves a child custody case from the State of: Utah.
Biological father going to retrieve children from another state. Other biological parent (mom) has died. Grandparents do not want to cooperate.
* Childrens other biological parent passed away one month ago, mid November 2015. Deceased parent was custodial parent and there was joint legal custody. There are no other parties to any other custody matters.
* Father resides in another state, mother resided in Utah.
* Father was in Utah when other parent died, made informal verbal agreement with grandparents to allow children to live with grandparents and finish out the 2015-2016 school year
* Father is a completely fit parent with stable family of his own in current state.
* Father was completely caught up on child support at time of other parents passing.
* Father has become aware that the living arrangement with the grandparents is unhealthy and could be harmful and potentially dangerous. Solid information from children's school and grandparents own son and daughter-in-law as well as fathers own observations confirmed this.
* Father verbally notified grandparents on Dec 10th that he was coming to move the children on Dec 29th. Grandparents agreed to cooperate with some reluctance.
* Children have been enrolled in school in new state where father resides.
* Grandparents informed father yesterday, Dec 22nd, they plan to no longer cooperate and stated they have filed a guardianship action.
* Father plans to proceed with move on Dec 29th. Looking for advice on how to avoid any potential issues when picking the children up.
