My question involves business law in the state of: California
Eight months ago my business received product without any work order or business name attached to it. We searched the web to find the person who ordered it and then find where he now worked. In the course of said months the work they wanted done was unable to be done due to them not giving us written permission to proceed with it. In December the person asked me to ship it to him, but I refused since the company is only 2 miles away and I had no hope of receiving any payment for the time and cost I'd put out. For six weeks, he's promised to pick it up but has not come in. I notified his manager and gave them a one week deadline saying we would be getting rid of it if not picked up by that date. The date passed over a week ago with no more emails and no phone calls from them. I sent out two more reminder emails and phone messages during that time.
Can I legally sell this product to another customer? We never gave them permission to ship us this product in the first place and did everything we could to do a job for them to no avail. It's been stored for free for eight months.
