A friend of mine was pulling out of a private parking lot. He was driving on a one way location on the wrong side. He was stopped, waiting for the cars to pass by. A bicyclist was riding her bike on the walk path, she didn't see him and hit him. The bicyclist was injured. The police arrived and said it was the lady's fault. She said she had no injuries and left. Now she is suing him for injuries and hospital bills. Is he at fault or she is?
