Asbestos Found After Leak

My question involves a consumer law issue in the State of California.

An upper floor condominium unit had a water leak. The water went to the lower unit causing very minor damage. CC&Rs state the upper unit is responsible for the water damage to the lower unit and the upper unit insurance company is covering the repairs. However, during the repairs, the lower unit discovered asbestos and is demanding that it needs to be mitigated. They are asking the upper unit owner to pay for the asbestos mitigation. The insurance company will not cover or pay for anything to do with asbestos. Is the upper floor unit owner responsible for the asbestos mitigation? The water damage did not cause the asbestos to be in the unit. I would think the lower unit owner would need to take care of their own asbestos mitigation, or could the HOA have any liability here?
