Auto Insurance: Hit by an Excluded Driver, Now What

My question involves insurance law for the state of: Texas

Hello,
I was recently involved in an auto accident. I was driving down a street and a driver that was leaving a parking lot turned out and hit me in the rear passenger area. My car (still being financed) has probably a good 3000 dollars worth of damages. Exchanged information with the guy, but made one HUGE mistake and didn't file a police report. I called the local police station to ask for an officer and the lady told me for an accident where no one was hurt, she don't recommend having an officer out just trade information. We did and before I could even get home the guy called my insurance company and filed a claim. I had a harder time getting a hold of his, but eventually did. Well two weeks after the accident his insurance has denied any claims because he was an excluded driver. My insurance company is telling me I can file through my own insurance. My biggest concern is raise in insurance rate and my child's car seat (has to be replaced after any kind of accident per manufacturer). I feel like, I am being punished for an accident I didn't cause. I know my insurance is there for me to use, but at this point with the deductible and rate hike I will surely suffer, it makes me wonder, why even file a claim? The deductible is more than what the child car seat cost.

Is there anything I could do at all for them to take responsibility for their own mistake? I suppose I could sue them, but the amount I would pay to lawyers will probably be higher than the damages. However, the damage itself is too expensive for me. Also, the impending rate hike I would experience for who knows how long. It would probably be an added 30-50 dollars a month. Doesn't sound like alot of money, but for a student working full time to support myself and kid, it is a big amount :(.

Another note, the person who drove the car told my insurance company that his mother (who is the policyholder an car owner that she was driving and I believe the mom admitted to it to).
