Building Permits: What are the Risks to a Contractor for Performing Services Without Required Permits

My question involves a consumer law issue in the State of: Hawaii

Hello, thank you in advance or your answers.

I have a specialty construction company specializing in residential structural repairs. Most homeowners want to spend the least amount of money possible. When I make initial site visit, I'm able to determine the problem and make recommendations. I have an associate engineering firm who provides professional engineering services, drafts and stamps plans for these projects.

If the owner wishes to not to elect proper engineering services because of cost, I don't want to lose the job. Therefore, I let the client know that I recommend they spend the money and have an engineer draft and stamp a set of plans. I also recommend they obtain a building permit. If I was to force engineering/permitting on them as a condition of my company doing the work, 9 of 10 clients would not hire me. In efforts to respect their wishes not to spend the extra money on the engineering/permitting and in efforts to gain their business how should I handle this risk? Should my opinion and pproposed work fail, I feel that I would be responsible. I have decided to add the following verbiage to my proposal. Is this adequate legal protection for me and my company?

"My Construction Company recommends suitable professional engineering services (civil, structural, geotechnical, electrical, etc.) and City and County building permits in conjunction with our construction services. Should the undersigned owner/client elect not to employ these services, any damages, defects, or other matters related to, or resulting from the lack of these services shall be the responsibility of the client/owner."
