My question involves real estate located in the State of: Arizona
We have a property that needs a Fire sprinkler water line easement the water line is considered a private utility line and will only being servicing our property. The owner of the property that we need the easement from is unwilling to give it due to going into escrow very soon. We are going to be forcing the easement through amending the CC&R with another property owner (3 properties total are covered by cc&r) we believe the original intent of the CC&R was designed to allow these easements. Do you think we will have any problems forcing the easement through the CC&R ?
