My question involves vehicle registration or title in the state of: California
My Vehicle was towed yesterday due to violation of California VC 22651(o)(1)(A).
Excerpt:
22651. A peace officer, as defined in Chapter 4.5 (commencing with
Section 830) of Title 3 of Part 2 of the Penal Code, or a regularly
employed and salaried employee, who is engaged in directing traffic
or enforcing parking laws and regulations, of a city, county, or
jurisdiction of a state agency in which a vehicle is located, may
remove a vehicle located within the territorial limits in which the
officer or employee may act, under the following circumstances:
(o) (1) When a vehicle is found or operated upon a highway, public
land, or an offstreet parking facility under the following
circumstances:
(A) With a registration expiration date in excess of six months
before the date it is found or operated on the highway, public lands,
or the offstreet parking facility.
Here is the issue. I paid my Registration fee last September (I was not late) but didn't receive tags since the Smog was due. My car was parked on the street (legally) and the local Sheriff spotted my 2015 tags. They towed my car citing California VC 22651(o)(1)(a).
I had to go to the DMV, get a copy of my "Incomplete Registration", and a Onetime Movement form so I could tow my car from the Impound to a mechanic. The DMV cost me nothing except time, but the Impound fee was $295.00
My question is; Am I in violation even though I paid my Registration on time but just needed to pass Smog? Do I have "Expired Registration" and is it grounds to tow my car? If not what statute/law/regulation makes an exception for people waiting to pass Smog?
Do I have recourse?
I wasn't driving the car.
