My question involves an injury that occurred in the state of: WA. My son was in a two-car MVA in late 2011. He was defended by his insurer the the case, although half-heartedly. The case dragged along and Plaintiff was in another MVA after which her lawyer bundled the two cases into two accidents but one suit; two defendants.
Finally, almost five years after my son's accident there was a Settlement Conference held which he attended. Most of the negotiation was with the co-defendant's insurance attorney and they left the table without settling but within $20,000 of Plaintiff's claimed PI damages.
About 10 days after the conference my son got a phone call from his assigned attorney that the case was settled (for his limits). My son had insisted to his attorney that if there were a judgment that it be with prejudice. His attorney told him that it was so (in his phone call).
My question stems from having looked at the record of Court filings on the case for several years, the most recent filing was a couple of months ago and prior to the Settlement Conference. Is the settlement outcome not a publicly accessible record? How does a defendant verify that the settlement was realized and final, and that the case is closed? What written documentation does my son need to obtain for him to know that it is finally over?
