My question involves criminal law for the state of: Massachusetts
This isn't clear cut sexting with a minor, hear me out. Looking for some help.
I was on a site called Chatous (yes, a random chat site). Honestly, wasn't looking for what most people look for. I randomly was paired with a person who's profile said 41 year old female. So I hit chat and say hello. The other person says hi and that they are 15. I say ok and whats up, still not looking for anything sexual, I'm genuinely just bored. She says nothing and sends a picture of "her", non-sexual. I say nice and then she sends pictures of her bare breasts. Now, this was 100% unprovoked so I'm thinking this is one of those scammers that pretends to be underage so I toy with the situation. To see if these are pre-staged (as in fake, pulled from the internet) I ask the person to blow me a kiss. They send a picture of their lips, and then breasts, and it definitely isn't the same person. They are even wearing a different shirt, which I call them out on. The conversation continues for maybe 10 more lines where they are asking me to send them a naked pic. I send them a pic but not naked and say 1 sexual line, and then close the chat.
Now this situation sounds like I am leaving something out or I am making up a part, but I'm here for help and changing or leaving out details wouldn't help me. This is what happened.
It didn't occur to me until after that this could potentially have been a cop lurking for a sting, and I may have just (in the law's eyes) attempted to sext with a minor. I knew it wasn't a minor based on what I said above. Mind you, I am not banking on just blowing it off as entrapment because we all know how that goes.
So, in reflection, how would a situation like this go? As I said, I didn't leave out anything and the thoughts and actions did actually proceed as stated, but does it matter what I thought/knew or is it still "sexting with a minor"? What are the chances a cop would lurk on a random 1 on 1 international chat app anyways?
