Sales Agreements: Dealer is Advertising a Used Car with a Clean Title, but the Carfax Proves Otherwise

My question involves a consumer law issue in the State of: Nebraska

I found a car on Craigslist that a dealer posted. I went to the dealership and the car was actually in good shape, but I could tell the front end was new as it was in exceptional shape.

I knew the CL ad said the title was clean, so I asked the salesman and he confirmed that yes, it is a clean title.

I test drove it and it ran very well. I was impressed.

I went home and pulled a Carfax and turns out the title is not clean as it is a "total loss" vehicle that had to be towed from the scene of an accident with front end damage.

I called back today and again the salesperson tells me the title is clean.

Is this legal for him to do?
