My question involves personal property located in the State of: Maryland
My husky ended up biting a Pomeranian when we were out and about. That same day prior to the event, we went to the dog park and no issues. We also walked around and passed 50 other dogs with no issues. One puncture wound is considered a severe injury here. We heard the other dog snarled before the bite and we had people come up to us and ask if my husky was ok because she looked scared/spooked.
Animal control came to our house and took our dog. The other owner told them that she was walking down the street and my dog came out from under the bench on a retractable leash and attacked/lunged at her dog. She also got her wheelchair bound friend to say she jumped over her and scratched her. She completely lied to them because she was sitting 5 feet away from us, I don't own a retractable leash and all we had to do was barely stand up and pull them apart. She did not get up or move. She told us she did not see what happened or what caused it. But animal control took her story.
animal control won't let me have my dog back unless we put up a 6ft fence (which we can't afford), put a 10x10 cage in our already fenced in backyard (which isn't fair to our dogs because they'd never be able to play together again), or appeal. The appeal isn't until the 14th and that's only if we win. But it's our only option.
We own another dog, no issues. She grew up with another dog and several other dogs and a cat. Never ever had any issues. I have about 20 pictures to show her and other dogs laying on top of each other.
The other owner is expecting us to pay the full medical bill, but she has cost us close to $500 to animal control by lying.
Can we reasonable demand to have that taken out of the medical costs?. We were willing to pay for the bill prior to finding out she lied, out of being a good Samaritan because her dog got bit. We do fully believe her dog was the cause of it, but because it's so smal, it got the worst of it.
Also, how do we get animal control to believe she lied?
