My question involves a traffic accident in the State of: Texas
A little over two years a go I got into a car accident. I was at fault. At the time, my insurance had lapsed because my mother didn't give me the bill to pay to the insurance. It was bad judgment and I own up to the responsibility and am now insured.
Yesterday I was served papers saying that I am being sued by the other motorist's insurance company. It was filed in May and addressed to my old address. First I was wondering if it went into default judgment since I didn't get to answer back in the 20 days that was stated in the suit. Secondly what are my options?
1. Should I get a lawyer or can I represent myself to settle directly with the insurance company?
2. If the judgement went into default, can it be overturned since I didn't receive my papers until yesterday?
3. Are insurance companies willing to accept a cash offer for the amount less than in the suit? If so, how much generally?
