I filed a claim for SS disability in 2015. It was denied, appealed, denied and appealed again. I just got my letter from the Judge of the last appeal. It says that my claim was granted partially. It goes on to say that I was granted disability but only from February of 2017 and not November of 2015 as original file date. Then on the SSA gov wen site it shows my what my monthly benefit amount will be and how much back pay I will receive (minus the 5 months waiting period).
After the hearing before the Judge my attorney said that we would appeal if that was the way she was going to decide as I had plenty of medical records going back prior to 2015 that showed other issues (back, bowel, fibromyalgia and others). (The judge based her decision on the fact that an MRI in February 2017 showed severe spinal spondoylosis although I had complained of back pain for years with spinal stenosis showing before 2015). The only reason I did not get the MRI before then as my insurance required that I do physical therapy prior to being able to get an MRI and I could not afford physical therapy prior to September of 2016. Then I had to wait for doctor to get report, and then go back to doctor. X-rays at orthopedic doctor in September of 2016 showed these issues but no MRI at that time)
Anyway.. my question is that if I do the appeal (which I will most likely do).. 1) am I at risk of losing the partial favorable decision and lose my benefits, 2) Will I still receive the back pay showing owing to me currently 3) Will I still receive the monthly benefits while the appeal is ongoing
I know that the attorney wants to appeal for me and also to get the full $6000. But is it a good thing for me?
We have been barely hanging on financially since I could no longer work since 2015. My husband is on Social Security Medicare and that is what we have been living on besides selling everything we can, driving a 20 year old vehicle, buying nothing but food, going nowhere, basic necessaries only (at daughter's house on computer) and now my insurance is raising again this year. And with all my pre-existing conditions, not to mention the 18 prescription medications I am on to live, and now they want to try spinal injections but I can't have them done till insurance deductible is met. That is why we couldn't do the MRI sooner last year that they are basing the "disability date" on.
