My question involves a consumer law issue in the State of: ohio. My wife was shopping at Walmart and she purchased $50 of clothing at self checkout. She scanned the items and one item didn't scan unknown to her. She places the $4 tank top in the bagging area and scans the next item. The bagging machine does not throw an error. When leaving she is stopped by a person in athletic wear and asked to come to a room. They review her receipt and inform her that she didn't pay for the $4 tank top. She told the person she was sorry it was a mistake and she will go back and pay for it. There person refuses and demands so go to a back room. In the room there are 3 people 2 security guards and a cashier. She starts getting questioned about shoplifting. She informed them it was a mistake and she wasn't trying to shoplift. One securty guard agreed and said he kinda thought it was an accident. One security guard becomes very angry and demands to see identification. My wife asks "if it is agreed that it was an accident then just let her pay for the item and leave." She is then informed that she can't leave and if she doesn't give them any information they ask for the cops world be called. They then ask for her driver's license and Social security number. She gives them in fear of arrest. The SSN is told verbally out loud to The security guard which was written down and over heard by the cashier. After this she is free too go. Later she informed me that this had happened and we called the store and requested that due to being forced under threat to give out an SSN we did not consent to Walmart storing the information. I am now informed that they will not be removing the data. Her employer has stated that if her yearly background check shows she is in nrma theft database she will lose her job. She is a nurse.
Here are my questions.
1. Did Walmart break the law in obtaining the information
2. Does the cashier on the room violate compliance in safely storing private information.
3. Was her detainment legal since she requested to leave.
4. Since no charges where filed can she legally be entered into the database or is that defamation.
5. Who can I contact about this SSN concern.
