My question involves a traffic ticket from the state of: California
My roommate was driving my car and ran the red light. I received a ticket with a clear picture of him on it. He offered to "handle it" by writing a free form letter to the court explaining how I am not the person in the picture and how I can't get a hold of that person with a bit of a back story about how we met. Court responded to this letter with another request to ID the driver. I took over the situation and began researching.
I understand that legally I don't have to ID the driver. This is where it all should've ended.
However, since I have responded to the original ticket with this silly made up explanation, I may have given up my right to remain silent. Is that true? Can I still go back to the "It is not me - end of story" defence?
Also, if I show up at court, and police determines that my roommate was the driver (by pulling licenses for our address), will they charge me with perjury?
If I ID my roommate, will they charge me with perjury for the original statement?
Lastly, given all the circumstances here, should I even go to court? Or should I pay the fine and/or request traffic school?
I know this situation is stupid. I just want to find the least risk way to put it behind me. And if I could protect my roommate - that'd be a bonus.
