My question involves vehicle registration or title in the state of: California
I went to register my car at the DMV in San Francisco. Upon trying to do so, I was notified that I had $1021 in "Toll Citations Fees" from Fastrak.
As I am still getting myself financially stable after 9 months of unemployment, I was unable to renew my registration because I cannot afford the $1021 in fees.
This all came as a surprise to me because to the best of my knowledge my Fastrak account had always been paid and in good standing since opening it in June 2014. There have only been 2 instances where my CC information needed to be updated due to getting replacement cards and on both occasions, I called in and paid any fees I owed immediately. Each time the customer service reps assured me that I had no violations left on my account.
After the DMV trip, I called Fastrak Customer Service and spoke with an escalations agent who was able to determine that this was all due to a "system upgrade" that happened in late 2014, where my payment that I made in December 2014 covered the unpaid crossings, but for some reason did not remove the violations to my account, as it should have.
Now that he has admitted to this, he explained to me that I have two options:
1 - Pay the DMV $1021 that I don't have.
Submit a Dispute with Fastrak and wait 6-8 weeks for a resolution. When I win, they will then request a refund from the DMV which can take up to 90 days. So in short, I will be waiting close to 6 months to get my money back.
2- Submit a Dispute with Fastrak and wait 6-8 weeks for them to send me a "settlement offer" for me to pay for god knows what. When I pay this to them, they can provide me with an abstract to show the DMV. If I choose to go this route, it also sounds like it could take me 2-3 months just to get the abstract showing I don't owe the DMV anything.
Obviously I need my car as soon as possible, so paying it myself is probably the fastest way to get the car. But what do I do about the fact that I shouldn't owe the $1021 in the first place. Am I just going to need to suck it up for 6 months while I wait for the money?
Do I have any legal recourse here to pursue them for erroneously putting a hold on my DMV registration??
If I pay it myself, can I charge them interest for the financial hardship they are putting me through?
