Heirs and Beneficiaries: Husband Missing, Thought to Be Dead

My question involves estate proceedings in the state of: North Carolina.

My husband disappeared suddenly on April 9th, 2015. We were separated, but lived a few miles apart and enjoyed a close friendship, we had a son together and he visited daily. When he disappeared, so did his car. After the police informed us that foul play was suspected and dozens of tips came in to crimestoppers. I called the insurance company about theft coverage, which they declined because he was presumed Missing, not dead. The police located the car, abandoned in the woods. The windows were all open and the sunroof up, so there is a lot of damage to the interior. The police impounded the car and will not release it because it might be evidence in the case. My husband was on the title, but the car was insured on a joint policy. I want his car back, or the insurance to pay, is this within my rights? We are still legally married. Also, out of courtesy to his landlord I collected his belongings and put them in storage, (before they were forced to sue for eviction, in fact, before they lost any revenue from unpaid rent.) and cut off his utilities. He was unemployed and uninsured, so I do not expect any compensation for this. I am struggling to support two children and now have the added cost of storage, and no help from either father. The car would be a tremendous help, as my own vehicle needs a transmission rebuild. I don't understand why the police won't release the vehicle. And when they do, will I have to pay an enormous fee to reclaim it? Even though I asked for it immediately after it was processed for evidence. I don't even understand why they're keeping it, after all this time. They believe he is dead. Unless they find his body, it could be years before we can get a death certificate and look into social security benefits for his children. He has a daughter by another woman, several years older than my son. I know the children don't want to hear that their father isn't coming back, but their mothers could use the help, raising them alone. Please, any advice on getting the car back from police or getting the insurance to pay would be appreciated.
