Subleases: My Brother Was Conned. Rented House for Friend, Now Friend Won't Pay Rent

My question involves landlord-tenant law in the State of: Michigan My brother was conned by a woman, he rented a house for her on the pretense she would get a job and pay rent. (I know, right...) Her name is not on the lease. She moved in and kept all keys to house and the lease. He did not live there at all. Shes been there for 3 months, not paying anything, was supposed get a job and pay (I know, right....). Anyways, a retainer fee for an attorney is $1,000, he doesn't have the money, so I told him I would try to help him evict her. So I'm a bit confused, I'm thinking she would be considered Tenancy at sufferance OR holdover tenancy since she won't leave and wont pay rent and isn't on lease. Is this true? So do I still need to fill out the Notice to Quit or Demand for Possession with 7 day notice or do I just start the eviction paperwork and file with the courts? Never met her but thinking I want to get her out fastest way possible so she doesn't do damage to the property and cost my brother more money... Any help greatly appreciated. :wallbang::wallbang:
