My question involves estate proceedings in the state of: New York - Found a valid will for my dad who passed away eight years ago while cleaning out my mom's house who is in a rehab facility. The will that I found is dated after the will that was used for settling his estate in which everything was transferred over to my mom. I don't even know if the will that was used to transfer the assets to my mom was even filed with the courts or even of an estate tax return was filed as no estate taxes were due.
In this will, written after the one used, establishes a trust for my dad's half of the assets that can be used for the benefit of my mom in certain situations. Q tip trust. My mom does not object to the use of this discovered will nor do any of her children. Is it too late to establish a trust and pour his assets into it?
