My question involves an unlicensed driver in a mild fender-bender in: Missouri.
Hello,
I have been the primary driver of my aunt's car for a year and a half. I am chronically ill and am unable to seek medical attention due to lack of insurance, which impacts my ability to drive - as a result, I let my girlfriend drive my aunt's car so she could pick up a prescription for me. However, she is unlicensed, and only holds an expired permit in another state. Even if her permit were valid, however, she would be unable to drive the vehicle without a licensed driver accompanying her.
Two weeks ago, she barely tapped the bumper of a vehicle in front of her. When I say barely, I mean barely. But, it still occurred regardless of whether the damage was minimal or extensive. I was not in the vehicle with her, obviously. But this still poses an issue of how to proceed with remedying the situation.
The woman whose car she tapped was very nice to her, but she does not know that she is an unlicensed driver. My girlfriend shared the vehicle's insurance information, which is in my aunt's name. My aunt has disclosed to her insurance company that I am the primary driver of the vehicle. However, she has not said anything about my girlfriend driving the vehicle, as she is unlicensed. My aunt is not aware that I let her drive the vehicle, and for fear of betraying her trust and kindness, I am seeking to remedy this situation without involving the insurance companies.
The woman whose car was tapped contacted the insurance company, and thus my aunt's insurer is wanting a statement from me. I have told my aunt that I want to settle the damages out of pocket with the other party, and I told her that I wanted to do this because the damage was so minimal and that I did not want her insurance rates to increase as a result. She still does not know that I was not the one driving the vehicle. I do not want to disclose this if I do not have to, but that is a personal issue unrelated to the legal implications of this event.
I contacted the affected party immediately after the event and requested that she contact me, as I am the primary driver of the vehicle. I told her that I would prefer to settle the damages out of pocket because I do not want my aunt's insurance rates to increase. The other party also does not know that my girlfriend is not a licensed driver.
The affected party, obviously, told me that she contacted the insurance company, but that she would look into cancelling the claim. However, I do not know if this is able to happen unless i provide a statement to my aunt's insurer. They have called me several times but I have not answered, as I am usually sleeping since I am chronically ill. If I need to make a statement to my aunt's insurer in order for the claim to be dropped and settled out of pocket, I will do so, but I am sure they are likely to ask when and where the accident occurred, if I was the driver, if the police were called, etc. (the police were not involved because the accident did not particularly warrant any police intervention or mediation).
I want to settle this out of pocket because I do not want my aunt's insurance rates to increase, nor do I want her policy to be dropped because of a mistake that I made in allowing an unlicensed driver to operate the vehicle. I understand that I am complicit in the negative outcomes of this event, which is why I would like to try to remedy this issue without involving the insurers and without prompting legal reprimand against my girlfriend for driving while unlicensed.
When I do speak with my aunt's insurer, I do not want to lie about who was operating the vehicle. I am sure that the affected party has given a statement to her insurer, and she more than likely gave my girlfriend's name as the driver at the time of the incident. If I lie to my aunt's insurance company, I imagine this will illicit myriad negative consequences.
In short (despite my long-winded account of the accident and the circumstances surrounding it), what is the best way to proceed from here to prevent my aunt's insurance from being cancelled, and to proceed with out-of-pocket payment? Any advice would be appreciated. Thank you for your time and consideration.
