My question involves real estate located in the State of Texas.
My husband and I purchased a 3.89 acre lot in 1998 and placed a manufactured home on it as our primary residence. It is the back lot of an approximately 11 acre tract of land. It had originally been divided into 5 lots of varying sizes. What we bought was the back 2 lots (Lots D & E for a total of 3.89 acres). There is no one residing behind us. When the deed was filed it had a "right of way" attached to allow access for all to be able to enter their properties from the county road. This consists of .4 acres of our property. We did not realize that the deed does not acknowledge that there was no purpose for the right of way through Lot D since we own both Lots D and E and are at the end of the parcel. How do we terminate the right of way through our property? No one but public utilities and us have any reason or our permission to enter our property and there is no driveway past our home.
