Pretrial Procedure: Indictment Time After Arrest

My question involves criminal law for the state of: Texas. There was an argument in the motel room where my common law husband, myself, and my 25 year old daughter were staying. My daughter has Hodgkin's Lymphoma and is currently undergoing chemo therapy treatments. We were all discovering the chemo drugs were having sickening effects on all of us, so this subject was also part the ensuing argument. As the voices escalated I was trying to get my daughter to leave the room so everyone could calm down. The police arrived after 4 calls made to 911...3 of those calls made by my husband in an effort to get her out to stop the fight. He left on foot after a scuffle that had all 3 of us tripping over stuff and each other going to the door. He was arrested on 2 counts Assault Family/Household Member. He has previous convictions from previous relationship but I have no knowledge of this information. He has been locked up 8 weeks, he has a court appointed attorney that still has not contacted him. There is no court date pending by the jail's computer. I have delivered 2 notarized Affidavit of NonProsecution for me and my daughter to the attorney's office. I was told if they have to indct him within 90 days or release him as his charges are enhanced to felony due toprevious convictions. Is this true about the 90 day limit?
