My question involves a traffic ticket from the state of: CA
Without drawing this is rather difficult to explain, but I will do the best I can. My neighbor and we shared the same driveway. In front of his garage, there is a curb, and in front of ours, there is none. Hence the neighbor will use the same entry as ours to get into his garage (he has two vintage cars one in the garage and one in front of his garage before the side walk, he doesn't use these two cars, so he doesn't need to access his garage often). However, he feels even though there is a curb in front of his garage, it's really his "driveway". He has recently parked a 22 ft van along the curb and way passes where the curb starts. He has been cited a few times, but one officer didn't ticket him. our neighbor's argument was that he is only blocking his own drive way, and if we maneuver enough times, we can still get our car out. (I have a three month infant at home, and I find myself constantly drag the heavy baby carseat 200 yards down the street because I am afraid of using my own garage)
Is there any ambiguity in the law here? can anyone block a driveway when it's shared? if so, can we also block a portion of the driveway too? that doesn't seem to make sense to me, but I'd like to know the legitimacy for sure.
If we have the police tow his car, would we be anyhow responsible for the towing fee? As I mentioned, he has been cited a few times, he would just take the tickets and refuse to move the car, I don't know how to proceed with this issue anymore.
