My question involves police conduct in the State of: Oregon
While staying in a casino resort/hotel, couple got sent to hotel room due to being intoxicated. After lengthy discussion and staff threatening to call police and have them arrested for trespassing, staff and security finally escorted couple to their room and was told to remain there and are banned from rest of hotel property and to leave as soon as they can. 5 min later staff came with a police officer and couple tried to explain they were too intoxicated to drive and for them to not arrest anyone and they will just sleep it off. After another lengthy discussion, cop arrested female for criminal trespassing.
On police report, there was a statement made police was sent to the room after they saw the couple back down in casino premises after being told to stay in the room which was the sole reason why female was arrested. This is false as cop came within 5 minutes of being escorted to room.
Case was eventually dismissed. But arrest resulted in public humiliation for female and being falsely imprisoned ,and cost time and money for having to go back and forth to oregon to attend court dates.
My question is, is there legal standing for the couple and is this a winnable case? Also how long does casinos retain their security footage as that would prove that couple never left the room which contradicts statement in police report.
