My question involves real estate located in the State of: Utah
There is one family who had land and subdivided it, making a pud. They sold lots. Did not build houses.
I bought the house from the bank, as a foreclosure.
We do NOT have an HOA, but only CCR's
This particular person who is one of the main people to write the CCR's says that they only want literally a single family living in the homes of the community. The CCR's say nothing about that, but say homes are single family dwelling. No subdivisions of lots or duplexes or multiple homes built on a lot or mobile homes. It doesn't say homeowners can't have roommates or renters sharing the house with them.
See 4.2 in the CCrs.
He is telling me I cannot have a single roommate renter in MY house. How can this be legal? How can CCR's determine who lives in the house I bought?! He has threatened to take me to court if we got a roommate.
So my questions are:
Is this even legal to say no one can live with us?
Do they have to be specific in the CCR's. And if they are not, is this a loophole?
How could they prove I have a roommate anyway?
How can I fight this so we can have whomever we want living with us?
I feel this is like saying only white people can live there. Or only legally married couples. Or only Christians, etc. how can they choose, pick, enforce who buys home in their pud? They're not builders. Homes can be purchased by anyone.
