Relocation: Non-Custodial Father Trying to Move My Child Out of State

My question involves a child custody case from the State of: Colorado

Hello,
I have a 7 year old son and his father just informed me that is going to move him to Texas in a couple months. I had a bad year a couple years ago where I was living in Santa Fe then Nashville getting treatment. I have been part of his life the last couple years though and I have been paying him child support and back child support since. He seems dead set on taking him though and insists it would be best for our son. He says he can't afford to live in Colorado anymore and that he would live with his cousin out there until he found a place. I know I had a checkered past but I don't think just getting my son for 3 months in the summer would be best for him. I've offered to even pay more in child support than the court ordered. We have no custody agreements. I was wondering if this is legal and do I just need to take him to court? I know it would get really ugly, but I don't know what else to do.
